  • I'm just having a go at the reclaiming letter now....Shall I go for the 'Your member of staff did not ask me about any pre-existing conditions...' OR the 'I informed your memebr of staff of a pre-existing condition but it was not made clear the effect this could have on me...'??
    It's worth a try isn't it?!!

Stick to pure fact, if you are unsure of waht was said, waht for your SAR.

Regarding the policy, PPI needs to be suitable and alos the claimant eligible.

Suitable can be easily arguewd by the bank, i.e no existing cover etc.

HOWEVER eligible is very different. If you were not advised of the implications of Pre Existing Medical Condiitons (PEMC) at the point of sale, then that really is bad practice and not being fair, clear and not misleading. One of the major treating customer fairly principles.

I woud take this route if i were you, they should have asked if you have consulted a doctor in the last 24 months or if you have any conditions you feel may affect this policy. Without asking these questions the bank can not state that they policy was 100% eligible.

Postie been and nothing form Lloyds of London yet about the unfair rebate complaint. I doubt I will hear now until after new year... .

I have emailed the ombudsman though to request a copy of what they have written as my complaint.

I want near on £4K coming my way... (with the stat interest!!)

And then there is my final option:eek: if not...
