Hi That is correct they have 8 weeks to respond:D:mad:0 -
Hi Maxdp how are your claims going?DS1 12/10/04

Hi That is correct they have 8 weeks to respond:D
Hope she gets it sorted now.
I have spoken to docs about my cells and 15000 is normal for me (doc put satisfactory as I had the film done in 2004)!!! (yeah right)... getting really fed up now and someone is calling me this after about my node thing...
Also had another complaint number through about Firstplus  and it is completely different to any of the others. I am getting slightly annoyed at this. I have called them and asked what its about (as my previous letters told me that all had been closed except for the unfair rebate which is to be made to the insurer on my behalf) and then I have been allocated another about settlement... I only ever had two complaints, the settlement of the loan and also the rebate of the PPI. I got them before an adjudicator in may of this year and were together with one complaint number and they got closed as not within their jurisdiction.
I then resubmitted again one for unfair rebate, which is apparently having to go to the insurer as it was the terms in the insurance policy that determined the unfair rebate. Iwas told that last week and then had a letter to say my other for unfair settlement was outside the jurisdiction so closed. I have now had this today and its so confusing....with another complaint number.0 -
Hi everyone
I am back, it was my battery charger that died on me, hubby went on bought me a new one earlier, but the problem I'm having right now is as its a lappy I do not normally use a mouse, for some reason I cannot use it without the mouse, any suggestions? My son is at work and me and hubby have not got a clue, or is it something to do with the settings?
Its taking me a lot longer using a mouse lol......:o
Right, it seems I have lots of posts to get through and Marshallka I have received an email from the OFT, looking hopeful, will let you know soon hunni.
Hope everyone are okay.;)0 -
Hi all.
I put a letter into Paragon regarding a loan I had with them a couple of years back.
They've wrote back saying:
"Your application was submitted to Paragon by your brokers, E-oan.co.uk (now Twopart Limited).... As Paragon was not party to the conversations you had with your broker regarding the sale of the insurance, I am unable to comment further in this respect. I would, therefore, recommend that you contact your broker directly with your concerns regarding the sale of the insurance"
After a search on this forum, there's some discussion on Twopart/Eoan being liquidated? I don't know much about liquidation, so if this is the case, how will it affect my PPI claim?
Many thanks
Hi there Linda
I am also one of those complainants, they had went into liquidation earlier this year, think it was approx May time, I made contact with FSCS, if you google this in your search engine they will come up, then click on consumers, they have a contact number or you could email them to let them know your situation, and if you request for a form, they will send this in the post to you, I am aware they send these forms out in batches, so give them your address and ask them if emailing to confirm they will be doing this.;)
If you rather ring them their contact number is also on their site.;)
If you require further info, just give us a yell, I see our Marshallka has already helped you here.
Good luck

Cheers, I am happy to be back, even though its taking me longer to post lol, I see that Lynda has mentioned about Twopart eloan, but not yet got back, yet I have not read all the posts yet, is she going to register her claim with the FOS?
I was going to post the email on here from the FOS, but do not want to confuse anyone.....I really do not know what to say about it really, but as far as I know it was "End" who calculated it when settled......
She told me that it is a complaint that they can look into for definate and once its with the insurer (they will write on my behalf) then they will give them 8 weeks to respond and it will be within their jurisidiction. I was told that the way that your rebate is calculated is within the terms and conditions of the PPI policy (its either rule 78 or pro rata and Firstplus did it rule 78 which was the difference between yours and mine if you remember). Also unfair rebates are complaints that fall in the unfair terms in consumer contracts regs and I have checked on lots of reclaim companies about this too so dont want to dishearten you Di but they may not see this your way here unless like singlep says, you can prove the rebate was unfair... I will try and find the figures again and look.... I just wish tiggrae had explained her complaints procedure for unfair rebates a little more. It was her that told you to go for this one against endeavour...

Good you have had this confirmed.;) And good luck too (3rd time lucky for you I hope).;)
Yeah I know what you mean, in fact I did find a bit more paperwork on them today, still nothing about cancellation but a small paragraph saying that I have a "short time" to let them know if I did not want to go ahead with the agreement but they did not state an exact amount of time, there is more but will have to get the magnifying glass out lol.
If I have no luck then maybe a miracle will happen with the brokers lol....:D , if I'm lucky that is and that would be for mis selling then.;)The one and only "Dizzy Di"0 -

This was the letter Tiggrae helped me with here and M Colak done the calculations of this.
Unfair Rebate Settlement/Account policy number –
Dear Sirs
I am writing in regards of an ‘Unfair Rebate Settlement’ in November 2005.
Account Number XXXXXXXX
Only a fraction/Part portion of the rebate of £1533.69 was deducted within the settlement calculations and it was not explained how the rebate was actually calculated, such as for example the loan, payment protection insurance or both.
The full amount of settlement to settle this was £23,646.04, yet I note that an amount of £26565.18 was received of the full payments received to you on a policy of £23,835.00, because the loan amount was £21,000 and the payment protection insurance was that of £2835.00.
All the above is proven on the paperwork received within a Subject Access request that was provided Endeavour Personal Finance to me.
I believe this was an ‘unfair rebate’ considering the 25 year policy was taken over 25 years and settled the year after. I believe I was deprived of this money.
I have sought further information about ‘Unfair Terms in Consumer Contract Regulations 1999, through the ‘Office of Fair Trading, this came onto force October 1999 as the Unfair terms of Consumer Terms of Contracts regulations 1994 are herby revoke.
I am also aware that the FSA rules that firms should give a fair refund.
I was not given a refund only a part portion of a rebate settlement as stated on your letter, yet your Endeavour paperwork states, ‘if settle early you may be entitled to a refund’ this is my opinion is not a rebate, and could be read as mis-leading by consumers, such as myself for that matter.
I do not feel I was treated fairly, and would appreciate it if you could uphold my complaint and refund me the amount worked out of approximately £3722.68, and 8% of what a court would award.
If this is not resolved or upheld in 14 days of this letter due to the unfair settlement conditions, I will be forced to complain to the Financial Service Ombudsman, who will be able to investigate this on the grounds of Unfair Settlement Rebates.
I look forward to receiving your response within 14 days of this letter.
Yours faithfully
Then they would be paying you to have the loan. Sometimes tiggrae did not look at the whole settlement and I have and will post it somewhere. I suppose you have sent this into the FOS, a copy of this letter!!!.0 -
