    This was taken out in 2001 but I remembered why I rang them, then wrote to them after as I was confused, it was to ask if they can cover me because hubby was off work for a while, they said I was not eligible as explained in the policy booklet earlier sent.
    No I did not cancel at that time because I did not think I was allowed to and this was not asked of me either, just like when I had taken this out in jan 2001 I thought it was an all in one agreement, I only cancelled after it was settled to ask them to stop sending me out further cards, but they did not oblige by this.
    Settled Aug 2004.
  • Thank you di3004, i look forward to seeing more posts, i am of the opinion that it was i who paid the insurance and it should be i that recieves it as it was an unlawful charge levied to get the credit card, this has happened to me on 4 occasions now and i wondered if i could get the cloaims company to address this, as they quote i will recieve 100% of the compensation, but i havent have i my creditors have?
  • yes the letter says legally we are only obliged to keep records for 6 yrs
  • 13 yrs ago so it would be 1995 have i left it a bit late ???

    You could SAR them but they will only go back as far as 6 years with providing your documents, although I was lucky to receive some paperwork that went back as far as 2001 which they generally keep on microfiche.

    I don't really know where you would stand in your situation with this going back as far as 12 years in going as far as the Financial Ombudsman service, but if this is a banking complaint the rules may apply but I am sure this will be confirmed to you on here.

    Do you want a copy template of a SAR hun, which is known as a Subject access request where they must supply all info they have on your account, like I said going back as far as 6 years, this should still show you had PPI in this?
    There is a £10 cheque or postal order charge and they have 40 days from your letter to provide these to you.

    As always post by recorded delivery for your proof.;)

    I got my agreements going to 1997....I can only say that maybe if you do not have the agreement and they say they have not either (although if its only just finished or still in force I thought they had to provide a copy!!) then you will have problems with taking this anywhere. If you go through the courts then the limitations act would apply and FOS would most probably not be able to look into it either. You could always ring the FOS and find out first before going any further. They sometimes can apply the fact that you only just became aware and if its a bank etc they may have been members of the banking ombudsman before the new Ombudsman.
