they had sent me an email (FOS) that is last week, saying that there was a hold up with a 'regulatory matter'!! So I sent them an email asking what does that mean in 'Layman' terms, and this was their reply, but I still don't know exactly what 'our case and others' is!!! But you a right, so the FOS can say we should get our money back, but clearly Firstplus have decided that they are going to challenege them!!! Surely this shows that they are on dangerous ground, I think that if they agree to ours, then the flood gates will open - what do you think??
I got this one when I asked on 1st december. Catinthehat, was yours just unfair rebate????
Thank you very much for your email. My enquiries are on-going, and I am currently awaiting more information from Firstplus.
Without sight of the information I am unable to comment on jurisdiction. I appreciate that you are concerned about moving your case forward, however, I can assure you that we are doing everything we can to ensure that your complaint is progressed as quickly possible. As previously explained your case may need to be referred to our legal department, which means that it may take a few months before we are able to resolve the issue.
We will keep you informed, so that you are aware of the steps we will be taking.
Thank you for your continued patience
    Kind regards

Well catinthehats was about an unfair rebate that they offered back (a pro rata refund) and she took it to the FOS and I think its now about misselling too. Mine is about just unfair rebate as this was against the lender. This was told to us from tiggrae to go for unfair rebates against the lender and then FOS told both Di and me that "unfair rebates" are against the actual underwriter of the policy as the rebates are determined by these and not the lender. Now most of Firstplus's earlier policies were a consortium or insurers:rolleyes: but ultimately the insurer is LLOYDS and it even states on the bottom of the insurance policy that all complaints about the policy are dealt with by LLOYDS who were under the INSURANCE OMBUDSMAN SCHEME so would be compulsory jurisdiction... . But NO, they are now giving us jurisdiction issues even with this on the policy documents.

that's right Marshallka - ours was for mis selling which we took to FP - they offered us about £700, Laini/ Tiggrae worked it out to be about £8K + interest - so we declined their offer and sent complaint to the FOS - hope that makes sense!!:o
    DEBT free:j

  • And our payments should be reduced and they hadn't reduced them!!!
    DEBT free:j

  • Sorry to go on - but funny that when the interest rates go UP our payments do to, but in the last year they haven't gone DOWN:mad:
    DEBT free:j

Partly, I had lessons and had to try to think real hard and i just cannot that quick really. I am left handed if that helps you understand.... .

I stopped my lessons when I started with BPV in 1997 just after giving birth. It meant that everytime I tilted my neck backwards I got a nystagmus (violent movement of eyes something like the exorcist really!!) and everything span around (not good when you are driving). It even happened in my sleep on turning over. I got it twice for 6 monthly periods and then paid private and saw a neurologist in 1999 and he cured me there and then of it but COULD return again... I had to be spun around and hung upside down and tilted this way and that to get the bits of bone inside my ear glued back down again and then I had to sleep sitting up as could not lie down for 3 days... . My docs thought I had a thrombosis and it was mini strokes...

I never returned to driving after that and have lost all confidence now cause of things... and never had the money again... .
