    Hi again all,

Just thought id post a quick up date on my situation

Got my first letter back from LLOYDS TSB credit card (Insurance) , tho unlike the first letter from their loan people, it was a nice one, not telling me to sod off!

    Dear mr M

I am writing to let you know that we've recieved your complaint and to say how sorry we are tp learn that you're unhappy. .................................
............................ your have my assurance that one of our case handlerss will investigate the concerns you have raised. This may take alittle time but we will do our best to complete our equires as soon as we can. We will then be able to respond in full to your complaint, and at that stage, Ihope resolve matters.

It then goes on to tell me how i can cancel the cover...... which i have done all ready!!!!! stop cuting and pasteing Tsb!!!!!. Also this time its signed by hand ... wow! They say it will take 8 weeks to look at.

Is this the norm for them?

    spanks for your help

    Hi

In my case that is normal for them. They are very polite and helpful etc but I have found the outcome is the same e.g. Tough:mad:

Hopefully you will get yours settled quickly, fingers crossed.:D

No, none of them are correct as they have worked them out wrong and I can prove it too and have now sent this off the adjudicator for his sending it to the Co-op. Going to be in the same boat as you here maxdp.

    Am sorry about that Marshallk

I liked the letter though. I do not know why they are working these out wrong the do all their figures without interest. But they do go on to tell the business to add all interest etc "to put the consumer back into the position as if they have never have PPI" that is what gets me because these people do not.

Just spoken to my adjudicator and he has said to me that what I have sent in the email is absolutely what was needed. He had now sent this over to the co-op and will await their reply. I have just said that they have to SEE they are wrong... He has said that it can now go to the Ombudsman if needed so will just have to wait a bit longer but I feel that £2300 is a lot of money to be deprived of by accepting so I will chance it. I know they have included in their calculation of the settlement another £500 from somewhere on the 1999 loan as I do have a breakdown of the settlement for that loan and that £500 is what I am short of in there redress. I just want this proving otherwise and really cannot see how they can...:confused:

Well done Marshallka I hope this gets sorted out for you. Have still not sorted my figures out yet.

  • I took out a loan with Black Horse in November 2003 which i was told must have PPI on it.

The loan was arranged on the phone and i just received a form to sign and return. which i did

I have now written to Black Horse on several occasions and their stance is that unless I can prove that they told me that they wont play ball.

Have been to FSO but they wernt regulated by them at the time i got the loan.

Been to FLA who are rubbish, they just resent what i already had.

As this all occured on the phone, and i like most people dont record our phone conversations, how am i supposed to prove what they told me on the phone?

Please help as this is beginning to get to me.

    Thanks

    Hi there
I thought I had read up that Black Horse were regulated by GISC prior to Jan 2005, unless I have the wrong firm, maybe someone else could confirm this.

Have you tried checking the regulation part of it with the Financial ombudsman service? here:
    http://www.financial-ombudsman.org.uk/contact/index.html

They will or should be able to confirm this to you.;)

So this was in 2003 then ?

Phone sale or not they should still have documents to provide you hun, request for a copy of the agreement, they may charge a £1 or this may be free, but ring first just to make sure if there is a charge or not, do it by cheque, you will know this is taken out of your account then, and they have approx 12 days to post this to you.
After ringing write a letter to request this, its far better in writing as its your proof and always post by recorded delivery for your proof.

You could have the option of requesting a SAR which is a Subject Access Request, there is a charge of £10 cheque or postal order payment for this and they have 40 days to post you ALL the information they have on you.

Its generally more difficult if the 6 years have passed by of obtaining your documents, do hun go for either of the above.

If you require a SAR template let us know one of us will post it up here for you, not unless you have already done this of course, good luck.;)

What reasons did they give for not paying out. They are to cover you for unemployment dreamer but don't think it pays for reduction in hours... .
I had surgery & was off work for 6 months, so I claimed for PPi on the accounts, I thought when I took out the ppi's that they directly paid the minimum amount on your accounts if you are unable to pay because of illness or redundancy ( in my case illness),if I thought that i still had to pay the minimum amount every month i would not have taken out the ppi's in the 1st place.can I still claim for the amounts I have paid since they paid me 2 1/2 yrs ago, I still pay ppi's on the accounts:rolleyes:

    Hi there hun
I have not got a clue about calculations, but I am sure this will be checked for you.;)

Generally they have to put you back in the position as if you did not have the PPI to start with and if the loan is still active, you should have the option of having this paid directly to you or to have a new lower repayments, some have to have a new loan.
So basically you should receive the FULL amount of PPI, interest plus an extra 8% Stat interest on top of that.

    Good luck;)
