  • Hi all - I posted on here a while ago with regard to our First Plus Loan which was taken out in 2004. I stated that we applied and wanted our loan to run concurrently with our mortgage which I believe at the time was approximately 23 years. We received a telephone call from First Plus after applying saying that we had to up the time to 25 years and that we HAD to take out PPI otherwise they would not consider us. I wrote to First Plus and had the standard response saying that PPI was optional and that on the recording it states all this. I have received a copy of this disc but this is the second phone call and I was under the impression that we had no choice about the PPI at this stage so I agreed with it all. I asked FIrst Plus over the telephone for a copy of the original phone call where it was stated we HAD to take the PPI and apparently that particular file is corrupt! I just wanted some advice as to what my next course of action should be. Sorry for waffling but look forward to hearing from someone? Thanks

    Sorry to hear of this.
    I am sure Marshallka will have something to say about these sometime today, but don't let that stop you continuing with this complaint, I still think you have a good case here.

    As you may know Marshallka has had dealings with these and know how they work, there are ways around this, so keep an eye on the thread throughout today.

    I recall that these were not covered by a regulator at the time you had taken out the loan , but like I said there are ways to work around this.

    Was that the first response to your letter?, if so another letter maybe required in order for them to reconsider your complaint.

    Keep checking on here for some answers hunni.;)

    Right, I take it you have already requested a SAR from them...or was it just the disc as mostly the phone calls are written on a computer in sorts...

    You would be able to take this to the Ombudsman as Firstplus were under the GISC in 2001 so that is one good thing.. Also just to be sure here - it was Firstplus that you took the loan out with and not a broker???

    If you went through a broker then its the broker you have to make the complaint to.

    As you have received a standard response here you now need to write to them again and state that you would like their final response in the matter or you will be taking this complaint to the Ombudsman.

    Also if you have only had a copy of the disc with the phone calls then I would strongly suggest a SAR here too.

    Don't give up on them... Firstplus are known for this

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    afternoon all,
    phoned FOS passed on to FLA spoke to them asked what they do, they said post all letters i send to them to the finance company, i said no mediation between the complaint, no we dont get involved, what's the point then. i asked if you have a code of practice & your members are not adhering to it you say they will be expelled from the association. if there letting these company's answer to themselves, they are not a governing body implementing codes of practice, what a sham.
    phoned OFT explained this to them & asked how is it fair.
    told to call FSA called explained, was told i needed to speek to insurance team, no answer have to call back.
    what a nightmare its no wonder so many people were ripped off.
    will let you no answer of insurance team at FSA, i think my only option is court. totally let down by a system again in this country. DEPRESSED:confused:
  • Hi ,
    After 3 letters to them I have just received a letter this morning from Lloyds TSB saying they are refunding my credit card PPI !!
    They say they are calculating how much and will be in touch in due course.
    Many many thanks to di3004 and Marshallka for their advice and to everybody else, good luck and dont give up.
