    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.






    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

I'm unsure whether this was mis-sold (I was a student in those days so the memory is a little hazy, and I don't have the documentation dating back to this time), however on reading some information on HSBC's website regarding complaints about PPI it advises to contact HFC. I've also read that HFC have been fined for mis-selling PPI, though dating after I opened my card account.

    Is it therefore worthwhile contacting HFC with the template letter (for previously fined companies) provided on the MSE website?

    Any help with this is greatly appreciated.

    What would you state as your reasons for misselling here??

    If it would help you, you could request a subject access request from them to have all the data they hold of you including phone calls. It costs you £10 but its a peace of mind thing (and proof) if you cannot remember. You obviously have doubts to be on here...

  • Silly question wuith regard to a PPI, i was sold a PPI back in May 03, up to now i have been paying £40 per month on it and did not know it!

    Tomorrow may be my last day of work through redundancy, will the PPI cover a car payment for which i have taken it out on?

    Also the car payment is in default (I was originally paying £195 per month and now the defaulted payment is £100 per month) Will the PPI pay the higher or lower amount and for how long for (taking into account i understand if i find work straight after i continue to make payments?)

    Sorry if i have posted in the wrong section but would really like to know before i take further action

    I don't know if you can claim on the PPI if the account is in default. You really need to check your terms and conditions on this one...:confused: ?

    hi thanks for the help. I took it out 4 years ago exactly... when I got my first mortgage. The mortgage advisor for abbey told me that it was insurance for my mortgage to be paid if i was taken ill., the cover was not explained properly and since reading this article now realise it only covers for 12 months.. my employer does this. i get 6months full pay 6 months half pay. and I have a pension., and a frozen pension. Am unsure as to that article though that she worked for NHS and said critical illness may not even 'kick in'.     x-ray programme helped uncover it.. it basically says if you are self-employed, a student, on a fixed-term contract, a public sector worker, a student or a housewife a PPI policy might not be worth the premiums you are paying ?? this nursing assistant's post is on here and she claimed 1900. I have had this for 4 years, the same time as her and pay nearly 39.00 per month. am covered via nhs like her. Have i been missold this ? I feel I have as was told over and over that I would need it and they knew I worked for the NHS. I put it on my mortgage application form ? thank you for your time. :money: :j

    Good for you Di.. take you away from here for a while. Everyone is out here. Daughter gone halloween party at an old peoples home and hubbie helping friend set the tv up and son just going the pub to his girlfriend... Just me alone here...

    I would now get the misselling letter in.

    Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.
