    I took out an hsbc credit card in december 02 and told the bank clerk at the time i was being made redundant and was about to go travelling america for 3 months or so, in america i got a job in the middle east, the job kept me in the middle east for 9 months every year up to present date. in jan 05 i told my bank about my new job and how long i was out of the uk at a time, i told them this because i was upgrading to an hsbc goldcard, i have recently discovered that i have been paying ppi this whole time and when i upgraded my credit card the bank just kept the ppi running. I got a copy of the ppi terms and conditions online and it clearly states that anyone outside the eu territory for more than 90 days would not be eligible to claim on this policy. not to mention that at my first appointment with hsbc i told them i was being made redundant ( she wrote this on the application form). does anyone think either of these points would class as miss selling because hsbc have sent their final letter refusing to repay

    Received a letter from Begbies & Traynor about Twopart Limited.

    Thought I supplied them with the amounts etc, but that may have been FSCS.

    Please can you confirm the amount for which you are claiming?

    Hi there and welcome

    It seems you have grounds for complaint here, especially as they were informed of your what was what etc.

    Get writing to them and try and reclaim this back, but check this below link out first, which should be a help to you and there is also a template letter, use your own words as much as you can with your own reasons, they have 8 weeks to respond, post by recorded delivery, as soon as you hear let us know and we will help you to the next step in case a further letter is required.

    I have already used the template letters to claim it back, the first one they replied with a bog standard letter saying i signed for ppi so it was not missold, they included a copy of my application which clearly had written on it that i was going travelling, so i sent a second letter detailing the points i was trying to make , they investigated for 8 weeks and replied that they where satisfied i had been sold the policy fairly, they didnt even acknowledge my points that i had insurance i could have never have used
  • Thanks so much di3004 and tiggare, I will chat to the boyfriend about both those suggestions and start getting the balls rolling properly on this.

    Will let you know if we get anywhere with it all.

  • Hello, the FOS have published cases where the claimants won on the grounds that banks didn't explain that the PPI would be front loaded, is the onus on the banks to prove that they didn't do this?? Mine was done in person at Lloyds so there's no way they could provide such evidence!!

    Sorry for mis reading......:o , right then hun its time to move on to the FOS here:

    You will also find the complaint forms on that page, not unless you prefer the FOS to send you these through the post - in that case give them a ring.

    Enclose copies of all correspondence inlcluding a copy of your final letter from the firm, the FOS will then send you a letter to inform you they have received the form and they will and should keep in touch with you of the progress in approx 4 - 5 weeks after the first letter and so on, but expect a wait hun as there are large volumes, but I am sure it will all be worth it in the end.

    Also send by recorded post as your proof that the form has reached them, good luck, you can also send a copy to the loan company, they will be aware then that you have gone to the FOS, you never know they may even change their minds and decide to give you an offer.;)

    There is still a chance of success here.
    Have you all the paperwork?

    Even if it were sold face to face, I know this can be their word against yours, but they should still make sure your eligible.
    The bank will make all sorts of excuses to put us off in hope we do not continue, but do not let them, if you think you have a case here then keep is going.;)

    The thing is here, I know the liquidators do not pay so much out, it will be less than the FSCS, although its not a huge amount anyway, but Marshallka worked it out for me as I had a fair amount of that rebated from the loan when going into a loan advance/consolidation.
    Just wait and see.;)
