  • Hi, me again. Feel like giving up already! have re-read their replies and my heads spinning already!
    Quick question: Ive got the original demands and needs statement I signed for Swift but although Ive ticked the box saying '...like to take out the insurances quoted etc...' the rest of the form hasnt got any of the boxes ticked so in theory I havent requested any 'needs and demands' does this mean that this PPI policy didnt exist?
    (clutching at straws arent I?!!)

    I had catalogues before but luckily no ppi and I have never signed any agreements...

    Is it catalogues here pinknico.. they never get anyone to sign agreements so in actual fact could never really enforce the credit anyway..

    Did you buy this laptop over the phone or on the internet...or was it in the store..

    If it was in store and you signed the agreement with a member of staff in PC world then they would be responsible just like if you go to a garage and buy a car. Its always the person that sold you the PPI and not always the lender.

    Just trying to save you some time here pinkaddict. Hope it goes well for you.

    Just been reading marlucs post and the reply from FF solicitors.

    I have been writing a second beast of a letter to FF, I have stated about non-advised sales prior to 05 and told them that he "strongly reco.....advises taking it out and that at that point it became an advised sale. The reason why its recommended is because we were lending over what the house was worth and mort cover thats it.

    FF did carry out non-advised sales but not in our case.

    I also have a telephone recording where my husband states we want a quote without ppi, the broker asks him why and he tells him the reason.

    The broker tells him and I have it recorded "Right the thing is if you can't afford to take PP out I don't think you're looking at the loan there basically".

    Gonna send it and try, think I have covered all things that their solicitors might come back with.

    Was it you that signed the one box then???

    It would seem strange that you would only sign one box and leave the rest blank??

    In your case dreamer, its good to look back at Marlucs posts. Mine was not sold by Freedom but like I say Kaia and Marcluc stuck at it and got them to the court stage and their solicitors paid up just before...

    Get a court case going NOW!!!! or at least write stating it...

    Hello everybody,

    I'm new to these forums and really hope someone can help. Here's my situation. In June 2006 i took out a personal loan with HSBC to buy a car. The amount I borrowed was £4500 over 5 years at 14.9%. I applied and was successful over the phone and all i had to do was go into my local HSBC branch to sign the paperwork and the money would be mine. The guy in the bank wasn't pushy but i think he mis-sold me my PPI because he told me that i could get the loan if i did not take out a policy where if anything happened to me, the loan would be taken care of. I reluctantly accepted this as i didnt know better. i have been paying the loan back for 2 years 3 months at £130.98 a month. When i have paid the money back i will have paid off £7859.06.

    This seems a lot to be paying back to me so i was hoping someone could tell me if i have a case or not

    If you actually mean here "where I could not get the loan unless I took out the policy" then yes, you have been missold.

    Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle. (if it is within the jurisidction of the FOS)

  • Hi Marshallka, yes Its the original as my signature is in ink and not a photo-copy. The rest of the form has boxes to tick for which demands, needs and product quotation but none of these have been ticked. Im the only signatory as all loans were in my name.

    Hello All, Its been a while since I was on here and Im catching up with all the posts to help with my claims against Welcome Finance and Swift Finance. I recieved the usual 'no-chance' first response from both companies in February but because of domestic and other problems, I havent had time to pusue my claims any futher. Am I too late to continue with my claims?

    (P.S. I dont want to sound sloppy but the marvelous advice and support on this site never ceases to amaze and delight me!)

    Did they give you six months to respond this may now be time barred cause you should have responded within 6 months. If you now took this to FOS (even though you do not have final response) they would say it is time barred I believe.

    Write to them anyway giving them your circumstances and see what their response is. Argue the points in their letter you do not agree with and keep fingers crossed:D
