I went to the cab about mis-selling the ppi, the guy basically said I did not have a leg to stand on and gave me a solicitor to speak to who deal in contract law, they were actually about 50 miles away from me, not in so many words but I knew what he was saying, however I did not see it this way and always had a gut feeling.

Blimey you had to travel 50 miles ?
So they could not help you then ?

You should do what you think is right hunni.;)
I think you have a good case here and you have fought this far, I wouldn't stop now either.;)

Have you sent the A and L one to the ombudsman about the telephone sale. I bet this will be sorted out for your before the Ombudsman even gets chance to look into it.. there is a waiting list of about 9 to 12 months...

Yes thats the one im complaining about, saying that i filed a complaint with the ombudsman about charges on a credit card, within 6 weeks they replied saying capital one will pay up :T

Just been looking on the FISA website found this:
If you are applying for a secured loan the law requires you to be given copies of the
loan agreement (and all relevant documents) in order that you can read the
documents carefully and consider the loan properly. You will have seven clear days to
study the documents. During this time neither the lender or broker is allowed to
initiate contact (they can respond to any questions or queries raised by you). This
period, known as the “consideration period”, gives you an opportunity to take
independent advice. You will not be given a “signable” copy of the agreement until
the expiry of the consideration period. Once the signable documents have been
received you have a further seven days to consider the loan before either the lender
or broker can initiate contact. If you do not sign the agreement the loan will not
    be granted.

Yeah Dreamer, just read this is for regulated loans only though...at the time of ours and all loans now though:mad:

I didn't know that the Citizens advice could check the enforcability of a loan agreement for you:D .

To check the enforceability, or otherwise of the credit agreement your mother could seek advice from her local Citizens Advice Bureau. She would need to take with her the actual credit agreement.

    This para is interesting:

The general rule is that you're bound by the terms of a signed contract. One exception to this is where the terms of the written contract were misrepresented to the signatory.

Maybe I'll be going for the loan amount and ppi lol

Yeah, what happens so I was told the other day is that when we file a complaint the Ombudsman Service write for details to the companies before they get to an adjudicator. Sometimes the companies actually cave in at that point and its at that time they are passed to an adjudicator for finalising. Its not that they are fast tracked, they are just easy peasy ones. I wish all were like that. My co-op one happened like that...they said they would offer redress of one loan with no admitting anything...

Night maxdp, its hard with the kiddies I know... I neglect mine at the mo though lol. Feel like a terrible mother sometimes... You can tell how long I don't spend with them by the amount of time on here. If anyone ever looked back over my posting they would swear I had no-one to look after. I spent the whole day off here though yesterday....
