Right hun, not a problem, like Boo said you may not actually receive the original just copies, but fingers crossed hey?;)
Now I believe that Barclays were not covered by either GISC where the FSA had taken over in Jan 2005, unfortunately if your complaint was not successful the Financial ombudsman service are not able to investigate these complaints, but some with the same complaint at the same time with the same bank as these are trying the FLA here

Now going back to the agreement, they should really supply you with "true copies" of the agreement as your SAR requests for this, if they do not you can contact the Information commissioners office and see what they advise you to do from here if you feel you did not receive all requested in the sAR, they should be able to have a look into this for you.

We will take one step at a time in case of any confusion, send off for your SAR first if you want to do this and let us know when you receive this, we will then take off from there......;)

Where it says about salesperson mis-selling I'm not sure what to put or how to word it because it was an internet application with the boxes pre-filled for PPI. Any tips?

Hello, I have been reading this forum for a few months and have learnt a lot - Thank you. I was hoping for some advice please. I have completed a letter from a template I downloaded here to reclaim my PPI from my Halifax credit card. I was missold the PPI and have sent the first letter to the Halifax. I had a reply on the 12th Jan 2009 (just under a week after I sent my original letter) to say they were looking into it and will contact me. I was wondering - is it eight weeks before they have to give me a final response? And would this be from the date I received their letter or they received my letter? Thanks :-) KJ x0

All - had a quick look at the PPI guide on the FLA website - appears that there are 2 types - one where the bank advises you directly to take PPI (whereby they have to sell it to you appropriately, taking circumstances into consideration). The second is where you are provided with the PPI detail in paperwork (as is normally the case with a c/card) - in this circumstance, it appears that you, as the consumer, have to find out whether PPI cover is appropriate, and CHOOSE to opt in accordingly.
As my situation is no.2, I would assume any challenge to a bank or c/card company over PPI would result in a 'you're responsible, not us' type of reply...and I guess they'd have a point?
Anyone heard of a C/Card payout on PPI in these circumstances?
Sorry to keep reiterating this point - just trying to save on the time & expense of a SAR, if the payout is 99% not likely...
In my opinion, although others may have their own opinions here, I think reclaiming PPI on a credit card to be more difficult, although there have still been a huge success in these, but not sure with the FLA though to be honest.

KJ - is your circumstance like mine? Did you tick a PPI box on a credit card application form? Or was it 'sold' to you by a member of Halifax staff?
Just trying to assess the likelihood of a claim being paid if the consumer opts in without taking advice...

As i will probably get asked te security questions,so whats the difference or r they just stalling me???????
I would be surprised if they didnt want you to post the copies they have asked for but as this is a loan still running it may be different. All mine are paid up and a different address. xxDS1 12/10/04

Right hun, this seems to be an issue for others that have been in the same situation as you.
Do you mind posting what reasons you feel you were mis sold on altogether?
You need to write, "this was an internet application, where the Insurance boxes were pre-ticked, as you thought this was then part of the application",that was why you had signed it. Something along those lines hun.

Yes they have 8 weeks to respond in full.
If they do not keep to their timescales and you do not hear by then, you can still take your complaint to the FOS.
Halifax may try stalling.......
