PPI Reclaiming discussion Part III

    evening,

    not sure if anyone can help me on this one. we took a loan out from first plus in nov 2004, with ppi on top. we moved house in feb 2008 and settled the loan but feel very aggrieved about the ppi. we have written to first plus who we paid all monies too from the offset, and eventually settled the account with including the ppi. first plus have referred us to freedom finance, who we apparently applied to for the loan. they have replied to us, denying responsibility and they in turn have referred us to a broker based in gibraltar, bespoke finance who apparently sold us the load and ppi (never ever heard of them). bespoke have also written back saying that it is not their responsibility..... any ideas, suggestions or experiences as to who we should pursue for this, have first plus done this too anyone else? Thanks in advance if anyone can help!

    First Plus are a nightmare, most of the posts at the moment are complaints about them. You can either ring the FSA and they may help you with who you should be tracing, also go back a few pages on this thread and find a poster called "Insipience" and his signature is a link to a FirstPlus complaint forum

  • Evening all.. busy tonight I see.
  • I need some advise. Took out PPI with a mortgage in 2004 paid in total £2400 to Abbey. we were told we had to take out the policy with the mortgage else we could not have the mortgage. we stupidly signed the forms a bit gullible I know but we were told we needed it. Since I have tried to claim the money back and Abbey said we have no proof in writing that the advisor told us we needed the PPI so they would not refund the money. The man from abbey was rude on the phone aswell and said anyone could say they were missold the PPI but proof was needed and that all letters do state that the policy can be cancelled within 14 days. I explained that I would go the FO and Abbey agreed that I should. But don't wanna waste my time- I know I was missold the policy but don't know what to do next?? any ideas?

    Hi there

    I would start by requesting a Subject access Request (SAR) they have 40 days to supply you with all the information they have on you.
    They should go back as far as 6 years with information, sometimes your lucky to receive some info from earlier years, but I see yours was in 2004 so you should receive everything then, here below is the SAR template, there is a charge of £10 cheque or postal order payment for this, and post by recorded delivery in order to keep a check on the 40 days they have.;)
    We can then move on from there, maybe with some useful information about the insurance as well will be within the SAR.;)

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

  • Following up from that post of mine.. I have developed a three pronged attack

    1. The Broker
    2. The Lender
    3. The Insurer

    Each with different complaints, however if the broker is gone tits up or was unregulated then you just pursue the Lender and Insurer.

    Just remember that your complaint is not just about the sale of the payment protection.

    If the Lender is giving you a hard time, then its time to return the favour.

    Send in as many complaints as possible, making sure they are all unique.. Each complaint can be taken to the Ombudsmen.

    Think we posted the same time above lol, thanks Incipience, would it matter if our cases are within the FSCS right now, because these particular ones are the brokers who dissolved and not the lender? Thankx
