If it was bought off plan then I think the solicitor would have been negligent in not advising OP of the risks of exchanging contracts with no certain mortgage offer in place. He should have been told that market conditions could change and lenders' attitudes could change in the period up to the practical completion of the flat.
Richard, if this a genuine statement you have restored some of my faith in your Profession!
The reality is that the developers and estate agents responsible for selling off plan generally had links with solicitors who simply turned them out ten a penny.0 -
To the OP. Take your loss like a man and stop whingeing. And next time don't be so bleeding greedyKrusty & Phil Madoff, 1990 - 2007:

The OP is simply asking for some advice on how best to deal with his predicament, he is neither whingeing or trying to avoid the loss.
His actions have nothing to do with greed.0 -

While this is true, how would a solicitor prove he didn't? Do they have the same paper trail that a mortgage advisor has, where there's a paper file with signatures and evidence?
In my experience, when you buy a house the solicitor goes through everything in the contract that's even slightly questionable - and all the tiny clauses. But many buyers just have their ears closed and are either not listening, not thinking it wil matter, or don't understand.
How can it be proven: "I told you", "No you didn't", "did", "not", "did", "not"?0 -

Idiot. You're obviously either incredibly stupid or just arrogant. The OP isn't here to whinge about what's happened, in fact he's been very gracious to the abuse he/she has received.
As far as I can see the OP is asking for advice about the situation they are in. With 8 pages of posts already, I think we have covered the motives behind his purchase, and as for your stupidly abrupt comment - you can keep that to yourself.

Totally agree redrabbit29. The Op seems like a genuine guy that has been caught up in all this hpi total rubbish.0

But what we are missing here... is that the BTL empire guys started life just like this fellow here.
Right? They bought 1 BTL property... then another then another...... should we also help them out because they lost all their property and now will lose their 10 bedroom 'family' house?
Seriously many people are homeless in the world... some not by choice... we can't help everyone. As a Father, a Provider for your family you must make things work.... if the risk is too great for your family then don't do it.. live a normal life... work... pay the bills.. be happy..
When greed comes into it, then things go to tears.
Im sure at 25 you made stupid mistakes too. Maybe not as big as mine. Came here for advice from the good people here, but you look like more in need of it.0 -

If everyone had to follow your example of being normal and working to pay the bills you would find that there would be no one to work for (IE the Entrepreneurs would not have created many of the businesses that employ, because they would be too busy looking for a job to live a normal life) and there would be few bills to pay as many of the suppliers of the goods would not exist for the same reasons.
