    If we wanted the world to be safer we could just stay at home, not have any knives in (just in case - cut yourself) not eat (just incase - food poisoning), not have a bath (burn yourself), cross the road (run over) swimming (drown)....

    Not be born, because it will lead to death in the end..........

    Hang on, can we all sue our parents for being born for the death that will ultimately happen to us, because it's their fault we we're born?

    I can remember my brother breaking both feet simultaneously, the reason was a rubbish shute in his towerblock, had been replaced upside down, when he went to open the chute, the whole steel frame and door crashed to the ground, crushing both his feet.

    He was off work for 3 months, he didnt "sue" because he was afraid "someone might get the sack", as a result, he suffered terrific financial losses. One could say it was "an accident" and "...accidents happen", but the fact is "accidents SHOULDNT happen", he SHOULDNT have to be off work, SHOULDNT be worried about the person who cant install rubbish chutes properly, risking a chance that he or she "may never be able to do it again", me I would have sued, theres no way I will allow somobody elses ignorance or neglect, to cause me financial burdens, no matter who they are. Imagine a factory boss in a tribunal over the death of the guy crushed to death, in a grinding machine, turning around to the judge ans saying "Hey,...it was an accident,.....accidents happen." I cant see a judge saying, "fair do's"

  • MY GOD! Have some of you heard yourselves! If someone is hurt and its someone elses responsibility to maintain health and safety to STOP people being hurt then why shouldnt she complain or even ask for compensation.

    Im sure some of you have never had to deal with someone who has been injured by a negligent party and has to struggle to pay the mortgage because they are only getting stat sick pay, it is difficult and depressing. The process to claim is long and drawn out so its in no way a way to make a quick buck! I feel that if you are injured you are entitled to ask for help or at least an apology.

    Ok so the OP may not have been injured badly but like someone else said what would have happened if this had been a child?? I think Tesco's need a serious complaint about this but I wouldnt ask for comp unless I was out of pocket through not working. The least tesco can do is try and make sure this doesnt happen to someone else which could potentially be far more serious.
    Will not spend more money:naughty:, but will spend more time looking for that great bargain!:dance:

    The other day I went to Asda and overheard something, I tried to hang around for as long as possible to hear the end but I could not as it would have looked way too obvious.

    This women had asked to see someone because her husband had eaten a carrot cake that it turned out was out of date.

    He was on kidney dialisis and was 'gravely ill and it could be serious'. Now serious enough to leave him at home while she goes and gets her £1.50 refund? Serious enough to wait around 10 minutes to speak to different people.

    I do not get it. What did she expect Asda to do? If the husband is getting NHS treatment then there was no cost to bear was there? Was it not their responsibility to check the cake before he ate it? I've eaten stuff a week out of dat - as have my family (not that I'd tell them that, the smell test usually works, LOL) but if they get ill then do I blame the supermarket?

    Blame, blame, blame. Who to blame. Someone else because we could not be bothered? What did she expect Asda to do? They cannot go into the tills and say 'here we go, have £2000 - is that enough to make up for it?'.

    So I came away a tad confused and short of following them around I never knew what the outcome was.

    Bottom line in law is that general damages awarded by courts are actually pretty low. There are no massive punitive damages awarded by the Courts in this country (unlike the USA), never have been and never will be.

    Am I right in thinking Australia has regulated it's "ambulance chasing" industry to avoid whats happened in the US happening there?

    I've already decided to sue my parents for making me ginger and too short, I can add being born onto my list. Hurrah!!

    As they are divorced, do you think I'll get a double amount from the claim. Something from each of them rather than a joint claim?

    I think we can all give extreme examples. But why would there be a legally-supportable claim here????

    Just because someone has a whine, doesn't mean that they are entitled to compensation.

    I agree in a case like this then you should get compensation and not be out of pocket for someone else's mistake. I think the whole point is the OP went for legal advice instead of going direct to tesco. Some vouchers/flowers as an apology should be enough and not to make a legal case of it.
