Hi,
Due to money being tight I entered into a concessionary payment arrangement with GE money and barclaycard.
I received a letter the other day from CL finance who explained that they have taken over my account and I should continue to make the payments as aggreed with GE money.
However, I've just checked my credit file and it's showing as 4 payments late.The lady said to me that it will go to 6 payments late but not a defaut as I'm on an arrangement.
My information from barclaycard is saying satisfactory.
I wish I'd never done it. This is going to muck up my credit file isn't it? I am up to date with all other cards/ mortgage etc. When I suggested that I pay the arrears owing so it wasn't down as late any more she said that would not be possible and it would have to go to six months.Will this be a default/ what is the real price for my credit file of this.
Any help greatful

Can a Bank change a Customers account 'type' without their knowledge or consent and then litigate?
Everyone that we speak to says that they can't, but where is the legislation saying that they can't? This is really important to us!

Can you elaborate a little on this or give me an example? Do you mean where a bank changes a basic account to a current account? Or is it more of a case where they lump more than one debt together (such as a personal loan and an overdraft) and then request payment?

Hi, l have a question!
We entered a mcol against ge money for mis sold ppi and charges, 4 days later they did the same against us. (separate claim, not counterclaim)They put in a defence, then we put ours in saying we aknowleged that we owed them some money but how much was the question, we said what we thought we owed and that we could pay £10 per month. Yesterday we had a letter from their solicitor saying a judgment had been entered against us and with it came payment slips requesting £125 per month!!lt's like they have'nt read anything we said.
Its all very confusing l hope you can understand what lm on about!!
Any advice would be really helpful.

Hi, maybe I'm worrying about nothing but I read in the paper that baliffs were going to get new powers to break into people's homes if they have credit card debts. Now I've debts right now and haven't defaulted, just been late and now there's noway I can pay all my debts so I have to go into a DMP and have spoke to Payplan about it.
I was wondering, if I did this would a creditor be able to get baliffs out on me? I know that they do for goverment - priority debts but not for credit/bank debts, (which I suppose that's why they're not priority) but could they? I intend to pay off everything I owe, as long as I do that with Payplan should things be ok?
It's the one thing that scares me. I'm a student nurse and I've never been in debt before, things just got out of hand very quickly and I suppose I was naive. Still, I've learnt something eh? :rolleyes:0 -

Need advice please. I started a dmp with cccs in nov. unfortunatly have just had to pay a large and unexpected car repair bill so its going to be very difficult to pay next months payment especialy at this extra expensive time of year. If I miss a payment so soon after starting is this a big problem? I really dont want to miss a payment but as I have no other way of getting to work other than my car I have to keep it roadworthy.I dont intend to make a habit of missing payments but dont know what else I can do this month. any advice would be welcome. thankssonnyboy0 -

The default notices normally go onto credit file if you have not met the terms of your agreement and the account is normally 3-6 months in arrears. So if you have not met the requirements they can place a default on the file.

If you have a default notice on your file it is down to the individual lender how they rate your suitability for a product, and this varies from lender to lender unfortunately.

Regards the fact that you issued a claim, and then they issued a claim it would be advisable to firstly contact the court to ask what happens when both parties take such action and what can be done if anything. If they advise you needed to take legal advice you can contact Community Legal Advice who may be able to help you.

At the moment bailiffs can only become involved if you fail a CCJ, and the claimant can ask the court to enforce the judgement. This can be enforced by bailiffs or an attachment of earnings or benefits.
At the moment we are unaware of any changes to this, and the link below shows no different to that information on Her Majesties Court Services website.
So if a creditor does go for a CCJ as long as you respond and start making the payments as instructed you would be ok.

Hi Callywally
You would need to call the number that is on your monthly statement as soon as possible to discuss your situation. Hopefully if possible you may be able to make a reduce payment at your next due date towards the creditors, and then resume full payments the following month. The sooner you give them a call though the sooner they can make alterations to your repayment schedule. I will also PM you the number just in case, and when you call make sure you have your CCCS information to hand.

Help! My partner has received a demand for almost £15K. He believes that the debt has come from his wife (who won't agree to a divorce) he doesn't know where she is and he always trusted her and did sign things without reading them......
The debt company are sending him a copy of the agreement, which we will go thro with a fine tooth comb as he does say he remembers nothing about it and at the time they say it was signed they had money in the bank, so it just seems strange.
My partner does not have any money, he was left with owning more on the house than it sold for and discovered a secured loan on it too. She had not paid utlities for ages before they split and he had to pay those too.
Questions:
Is there a way of stopping her running things up and him being liable. (He did inform Council Tax when she moved out)
Divorce - he was going to wait the 5 years for desertion, but now he has discovered the debt and lies albeit after they split would he stand a chance divorcing her for unreasonable behavior.
Should he file for bankruptcy? He owns nothing except a clapped out car which he needs to get to work and his clothes (Man at Primark ) There is no way in his position he can repay.
How does it affect me? I own the house we are living in and earn a good salary. I worry about ballifs etc.
