Hi and Merry Christmas!
I purchased a motorbike in Feb 2007 on HP with Black Horse @ 0% interest. I had to sell the bike later that year with the very best intentions of paying off the HP. The very week that I banked the cheque, my bank took £1000 to reduce the overdraft meaning that I was unable to clear the HP.
I have now got into real financial trouble and really worried about not making the payments. What is Black Horse likely or able to do. Could I ask them to accept a token payment for a while (as I am asking my other creditors to).
It has been suggested in the forum that I contact CCCS or another 3rd party and let them break the news to Black Horse, is this possible?
Any advice would be much appreciated.
Many thanks in anticipation

Hi I am a Newbie here! I am Just starting a DMP with cccs. I always pay my Credit cards by transfer on internet banking. The Bank account that I use is closing and I have opened a new one. Can I pay My Token payments via my usual transfers before my Dmp starts and my bank account closes?
I have to say What a 'refreshing bunch' you CCCs guys are!!0 -
i have 2 accounts with hsbc and also a loan with them. my loan repayments come out of one account but over christmas there were insufficiant funds in that account so the bank took the repayments from my other account which had money in that i had put there to buy my sons presents. can the bank do this. i have been telling them im having trouble paying the repayment amounts but the bank dont seem to want to help me they just say they cant change things and instead keep taking money then charging me for going over my overdraft. . im in financial hardship. what do i do0

I have a DMP with CCCS which I have been paying since February 08. I haven't missed any payments but this morning received a letter from Lewis Debt Recovery on behalf of CL Finance asking for the full amount of £2920.60 (which is a Barclaycard credit card debt) to be paid immediately. The letter states if they don't receive this amount by 1st January (and a Happy New Year to you too!) they will take futher action to recover the debt.
A payment of £10.62 has been made to them every month through my DMP and this has come completely out of the blue. Is this scare tactics and should I contact them directly or speak to a CCCS Counsellor after the holidays? Obviously I don't have the full amount to pay and don't want to be bullied into paying any more than I can afford. This letter arrived along with a letter from Tax credits asking for an overpayment of £1104!!! So I'm feeling slightly upset and fed up at the moment. Help!0 -

The debt company are sending him a copy of the agreement, which we will go thro with a fine tooth comb as he does say he remembers nothing about it and at the time they say it was signed they had money in the bank, so it just seems strange.
My partner does not have any money, he was left with owning more on the house than it sold for and discovered a secured loan on it too. She had not paid utlities for ages before they split and he had to pay those too.
Questions:
Is there a way of stopping her running things up and him being liable. (He did inform Council Tax when she moved out)
Divorce - he was going to wait the 5 years for desertion, but now he has discovered the debt and lies albeit after they split would he stand a chance divorcing her for unreasonable behavior.
Should he file for bankruptcy? He owns nothing except a clapped out car which he needs to get to work and his clothes (Man at Primark ) There is no way in his position he can repay.
How does it affect me? I own the house we are living in and earn a good salary. I worry about ballifs etc.
Cheers
Hi Metallicjin,
Thank you for your message.
This is a tough situation as if your partner has signed the agreement he would be liable, as he has signed to say he agrees to the terms and conditions of the loans.
With regards the divorce, he really would need to seek legal advice. You could pass on the number for Community Legal Advice they can be contacted on 0845 345 4345 or you could visit their website http://www.communitylegaladvice.org.uk/ .
I would not be able to say if bankruptcy is your partners’ best option as I don’t have all his financial situation, so he may be better calling for an appointment. If he would like an appointment with the CCCS our number is 0800 138 1111.
Let me know if you have any other questions

Hi Tomso,
Hope you have had a good one!
Are you 100% sure that this is a HP agreement? Sometimes finance companies will give you a personal loan (motor loan) rather than a HP agreement – double check this and let me know.
Is Black Horse aware that you have sold the bike?

Hi,
I have a DMP with CCCS since 2006.
My question is that one of my creditors is still charging me interest and as it's more than is being paid to them so debt with them is increasing every month and is cancelling out the reductions made by paying the other creditors.
The creditor has been asked on numerous occasions to stop the interest but has refused.
Is there anyway I could request that the payments be reordered so that this creditor's payment at least matches the monthly interest or would that be seen as favouring one over the others?
I am about to ring and redo my budget and increase my monthly payment but I don't think it will be enough to cover the interest for this creditor.
Thanks
