    Hi
I had a CCJ from Yorkshire bank for £1800 they have now sold the debt to Phoenix S.A.R.L and they are using Marlin finacial services to collect the debt.

The CCJ went into arrears Through my own pig headednes and now they have treatend me with a Statuatory demand, I offered them £100 a month to clear the dept but they refused saying its too late and they want 450 a month. I have morgage arrears im paying off and other debts im in arrers with that i am slowly paying off, What i need to know is, is there anything i can do to get marlin to be more resonable and accept a paymet i can afford as £450 will leave me with about - £200 a month. I know that i am in this situation through my own stupidity but i could really do with some advice now.
    thanks.

    Hi there.

I think with this one, you would be better speaking to us by ringing the helpline on 0800 138 1111. Statutory Demands can be quite involved and you need some in-depth advice which is difficult via this forum.

My brother is at his wits end, his wife has ran off with another man and left him with over £33000 worth of debts (besides the mortgage). She took care of all the finances and signed in his name using joint cards and cards in his name too -total of £13,500. Most of the time she has forged his signature for these debts. He does not know what most of it has gone on and it appears regular amounts of money have gone missing. She has since set up home with another man and only taken one credit card in her name for £8.000.
My brother works 6 days a week and assumed he had approx £12,000 on a car loan, in actual fact it was £20.000 he knew nothing about the rest and how it was extended.
He has put his house on the market and it will only make £9,000 of which she wants half this amount.
He is really struggling to pay all these debts so has moved in with us as to save on his bills at the house. He has frozen the mortgage payments for 6 mths at present.
Can she be held responsible for what she has done and is there a way for him to pay without getting black listed. Surely she must be held responsible for forging his signature to gain money.

    Hi there.

Your brother really needs to go to the Police. If he wasn't aware of some of these debts and is aware that his ex-partner had forged his signature she's basically committed fraud.

Any debts that he knowingly took out on behalf of her would still have to be paid for by your brother as he would be liable for those debts. I would say his first port of call would be to contact the police, and then he may benefit from speaking to use to look at his options for the debts that he is responsible for.

    Regards,

Have you read Martin's article on bank charges for people in financial hardship?

The Consumer Credit Counselling Service (CCCS) has several counsellors answering questions in our forum. There are three ways to contact them:

1 - To ask them a question please post it below and someone will post a reply here.

2 - If you would prefer to ask a question in private you can send a private message to one of the councellors: Matthew, Sarah, Alan or Sue.

3 - CCCS's Debt Remedy is an online tool where you can chat to a councellor anonymously and ask questions as you work through a budget plan.

I have done the Debt Remedy on the CCCS Site and just have a question.

Now it asks for my take home pay & also my Partners take home pay and then on the Creditor`s List it allows me to put my debts, our joint debts and the my partners debts.

The Remedy at the end recommeds an IVA, now I would like to do a DMP but am just wondering if the DMP will take into account my partner too as we both want to pay off our debts and its a little unclear if the remedy is just for me or for both of us.

    Thankyou in Advance.

  • Me and my partner have approx 30k unsecured debt and currently unable to make minimum monthly payments. Have spoken with CCCS they have advised the best option is DMP however I have heard bad things about these. I was hoping to go for IVA but have been told that is not an option if a DMP can take less than 7 years.
At minute not really progressings now creditors are phoning and writing more demanding letters. How can I get creditors off my back until I find a solution.
Also when I advised CCCS of 1 of the loans a query was raised on what I actually owe. The balance on the loan is 13k ish however the monthly payment multiplied the term left 23k. Which figure should be used by CSSS as the 1st figure means DMP but the 2nd figure would lead to IVA.
    Any advice would be appreciated.
