Hello,
I have had lots of help and advice from the people on this site.
Me and my husband have filled and sent back a N1 form to Northern Rock solicitors. With the help of debt advice line we filled in our budget and offered £10 per month based on us only having £17 per month left.
We are as happy as anyone can be with a charging order i guess and i know once i finish studies we will be able to save towards paying off the loan. (I have 5 years of studying ahead of me, and hope to pay the debt within 3 years after that).
Anyway the solicitors sent back a very quick reply accepting our budget and offer of £10 subject to the 'interim' charging order. (debt of £32.000)
1) What does Interim mean?
2) The advice line said we can get the court case moved close to home but if they have accepted the offer in writing will we have to attend? (It may be difficult for my husband to get time off, he has to give 6-8weeks notice for holidays).
3) If we dont attend will we have to write a statement or something to explain our circumstances? (or does it not matter now they have said the offer is acceptable)?
4) My main question:o ...We are aware that when/if we come to sell any equity will go towards the debt. We have a fixed 5 year mtg, when we come to re-mtg will they force us to release equity towards the debt?
We have a mtg of £112.000, house was valued at £130.000 (im sure its closer to £120.000 now- what we originally paid). If there is any equity it will only be about £2k. We would prefer not to release any equity (if there is any)...ever... just incase we need to sell in order to pay the debt of in the future.

Hi. My Citi Card debt ( Approx £8K) has been passed or sold ( Not sure which) to 1st Credit. Now, everything I read concerning this organisation leads me to believe that they don't take any prisoners, so I'm prepared for a tough ride. I've only had two calls with 1st Credit and both were quite threatening evem though I've yet to receive a single piece of hard copy correspondence from them and, the CCCS have only just forwarded my statement of financial status to them. If this is how they begin, I'm very concerned of how things will progress. My question is this: I'm fearing a Stat Demand from 1st Credit. I feel in my water that this is where it will end up. Should I request a CCA from them now, or, await the Stat demand if, and when it lands? Is there anything else I can do to be proactive? I;ve asked them to only communicate with me in writing. Its not that I'm afraid of talking with them, its just I feel that if this goes to court then at least I'll have a record of events. Whereas, they might hold a transcript of our telephone convsersations and I won't. Thanks for any guidance. Am I jumping the gun?
Hi there.
Are you currently on a DMP with us? I don't understand why you would aks for a copy of the CCA should you get a stat demand? If you are in dispute with the debt then you should not be making repayments to it through a DMP.
I wouldn't get youself worked up about something that might not happen. If you are making fair repayments to them then you can't be expected to do much more. A stat demand doesn't mean a lot unless they are actually going to persue with a petition for your bankruptcy, which would be incredibly difficult for them to do if you can show you are making every effort to clear your debts off in a reasonable amount of time.

hope this is posted in the right place, here goes...
My husband and I have received a small claims summons each for work done by a garage to both of our cars.
The amount in total they are claiming is £344.10 which we do not dispute ( we had told them previously we were having difficulties and he accepted this, until now.) I contacted his solicitor as there is expenses and interest to pay over and above. The solicitor has come back with a total price of £697.10 which we can not pay.
The paper work is not all accurate and I am wondering why we have two separate charges for fees, sherriff officers delivering the forms, raising it fees and solicitors fees. The copies of invoices have both of our amounts on them, suggesting to me one account and not two individual ones. They also have our address wrong and postcode wrong, which is why we did not receive these letters recorded delivery and now we are being charged for the hand delivery. Is this fair?
I do not want this to go to court as my husband has just started a new job which involves passing credit checks, and this affecting it.
Please help.

hi there can someone tell me that if i owe money to the abbey and mbna will they take it out of my alliance and leicster current account

Both Abbey and Alliance and Leicester are part of the Santander group. They are however still seperate organisations so they shouldn't be able to offset money from one to the other.
I would say to be on the safe side, it might be worth setting up another account elsewhere to give you piece of mind.

I have done a Joint DMP with my partner and at the end in the report it says we would have £530.00 left each month once you have covered all of your priority expenditure.
Now my questions are, do I just pay cccs £530.00 every month and then everything left from our income is for things like mortgage, utility bills and living??
Or is that aswell as our joint loans and credit cards?
Also if it is £530 we pay to cccs and the rest is to live on can we put money into savings or is that something we have to pay to cccs?

oops, sorry - 2 adults, one child. OH has no income. I am the only earner - part-time job plus full time student bursary.
There is nothing on there that is out of the ordinary. The petrol costs are quite high but if this is essential for work then it's not an area you can do much about. I'm not in the position to go into too much detail with your figures as that's the job for your counsellor when you have your appointment.
Try not to worry too much in the mean time, they will certainly discuss all your options on the call to look at the best way of dealing with your situation.

Bankrutpcy only effects you for 10 years if you are given a restriction order. These are only given out if the official reciever deems you to have borrowed money knowing you cannot pay it back, lost substantial amounts due to gambling, or have been bankrupt before in the past.
An IVA will only stay on your credit file for 6 years, much like the majority of people who go bankrupt.

Was CCCS meant for only UK citizen?
CCCS can only help people with UK debts.
If you are a non UK citizen but have UK debs we can have, and we can also help if you are no longer living in the UK but still have UK debts.
