Thanks so much Matthew for responding. And yes, I has a dmp with you to Citi, until recently when thwy assigned the debt to 1st Credit. At this early stage 1st Credit have sent one letter, following three of my own and two telephone calls to their office, which is purely a standard letter of notification that the debt is now with them. They are awaiting my statement of financial circumstances and, a proposed monthly payment plan from the CCCS. So, I guess I'm panicking before I need to. Its just their reputation is brutal and, I don;t want to be treading water if there are actions I can take now to ensure that I'm treated fairly. I have had lots of help and advice from the people on this site.
Me and my husband have filled and sent back a N1 form to Northern Rock solicitors. With the help of debt advice line we filled in our budget and offered £10 per month based on us only having £17 per month left.
We are as happy as anyone can be with a charging order i guess and i know once i finish studies we will be able to save towards paying off the loan. (I have 5 years of studying ahead of me, and hope to pay the debt within 3 years after that).
Anyway the solicitors sent back a very quick reply accepting our budget and offer of £10 subject to the 'interim' charging order. (debt of £32.000)
1) What does Interim mean?
2) The advice line said we can get the court case moved close to home but if they have accepted the offer in writing will we have to attend? (It may be difficult for my husband to get time off, he has to give 6-8weeks notice for holidays).
3) If we dont attend will we have to write a statement or something to explain our circumstances? (or does it not matter now they have said the offer is acceptable)?
4) My main question:o ...We are aware that when/if we come to sell any equity will go towards the debt. We have a fixed 5 year mtg, when we come to re-mtg will they force us to release equity towards the debt?
We have a mtg of £112.000, house was valued at £130.000 (im sure its closer to £120.000 now- what we originally paid). If there is any equity it will only be about £2k. We would prefer not to release any equity (if there is any)...ever... just incase we need to sell in order to pay the debt of in the future.

I really hope this makes sence...
1) Interim means that they have applied for a charging order against your house, subject to it being accepted through court. So at this stage nothing is legally binding, it’s simply an application.
2) I would suggest that you do go to he hearing. You don’t both have to go, but at least if one of you attends you will be aware of what is happening with the case. It’s definitely worth transferring the case to your local county court to save you travelling long distances. You will definitely need to go if you are wanting to try and defend the charge.
3) If you are happy to allow the charging order to go though, then I suppose you don’t need to go to the hearing, so there would be no need to send a letter in.
4) If there was enough equity in the property 5 years down the line when you looked at a re-mortgage you would need to pay off the charging order off in full. If there is not enough equity to pay both the mortgage balance and the charging order then you may struggle to get another mortgage as you will effectively be in negative equity and have a very low LTV. I’d suggest though, that maybe you speak to a mortgage broker nearer the time to get more in-depth advice with this.

I tried the CCCS online debt remedy but since i am not a UK citizen, i was asked to phone the customer services. i have done that and they DO confirm that they are UK citizen
Debt Remedy is only applicable for people that are currently living in the UK and/or UK citizens. Got a in-dept phone appt next wed 19/11 but..................
Applied for a new bank a/c as I have initially spoken to yourselves.
Gotta wait for that to be approved. Been told to transfer all the important
bills to the new a/c.
What do I do if this doesn't come through in time ???
What do I do with u/s debts, do I pay them & not eat???
Do I cancel all the DD's............Hubbie gets paid on 21/11
Really don't know what to do.
Do I use my wages to pay for food & not pay the bills
Please help me

Hi there, try not to worry.
If you are in the process of getting a new bank account open, just make sure you transfer all your priority living cost DD's over (everything but you're unsecured debts) once it's all up and running. In the mean time, offer your creditors a gesture payment of what you can afford, please don't go without food to service your debts.

i have done the above assesment, once you choose "no" UK citizen. it has you to phone up because YOU ARE NOT A CITIZEN.

Hello,
please could you give me some advice. I have just started a dmp this month, made my first payment on 1st due to health reasons have asked creditors not to ring me and so far no one has but I keep getting letters from creditors telling me ive missed payments etc even though they have been sent all the paperwork and a token payment for last month. So far i have anwered all the letters giving my cccs number and explaining the situation again but still keep getting the letters with no mention of the dmp. the letters say not to ignore my situation and to ring them which I am relectant to do as I want everything in writing. should I continue to answer the letters or ignore them or ring them? Is it normal for them to keep writing even though I have stated the dmp?

As I said, Debt Remedy is not suitable for non UK citizens, you must ring up for a telephone based appointment in order for us to be able to advise you regarding your debts.
