    Couple of questions regarding DRO's as I am currently waiting for my interview with the intermedary.

    1) My debts have largely, but not totally been formed due to gambling. Is this a situation that is likely to have a DRO refused?
    2)Is it the case as in bankruptcy,when the OR makes his desicion, that is it, or can creditors revoke the order?
    3) I understand that the only obvious reason for a DRO to be refused is not meeting the criteria, is this the only reason?

    You would be able to apply to the court to have the CCJ varied. To do this you would need to complete a N245, there maybe a fee for this depending on your circumstances. The N245 will give you the opportunity to put forward you income and expenditure and make a new offer of repayment.

    It is really important that you stick to paying CCJs, as the court have the power to send bailiffs or take the money directly from your wage.

    Thats what I thought. These are showing as being 4 - 5 years old but I have never even had a letter from the local court saying they are seeking payment. They are 100% for the one debt, I think they applied for all these to see if I would be silly enough to payor to ruin my credit score. I will speak to the company tomorrow, do I ask them to remove 3?? Sorry if I sound thick.

    Hi There,
    My husbands business is going under and I have recently been made redundant. I have been dramatically more frugal with my existance and only have a few thousand in debts (some of that was to help my husband) - bu my husband has very large debts... We have a "help pack" from one debthelp, and also mentioned that we were trying to get through to another but couldn't get through. My husband has agreed for someone to come round and speak to us, however I have a concern about what the person said. (I cannot see Martin endorsing ANYTHING that does not benefit a consumer). This person said that the companies we mentioned are in part funded by the banks and other financial institutions and that we would end up paying for debts for practically the rest of our lives.... (well, he did say the next 30 years). One phrase used was that debt help organisations maximise the debt for life - sounds like a load of jargon to me.

    I'm not going to mention the company name on the board as I consider what they have said to us one the phone to be libellous if it is not correct (hence why I have not named the debt help organisations concerned) and although this is posted to CCCS advisor, CCCS is not necessarily one of them I hasten to add.

    Is there any way that I can try to check these people out. They are not hiding the fact that they will make a charge for their services - but the initial meeting is free. I question what they said as I know that if there is anything dodgy about the organisations we contacted, they would no have appeared on martins web site!!!!

    Can you offer any help or guidance at all, that would be most appreciated.

    This is a very stressful time. I had just returned to work from maternity leave and I have a 7 month old daughter, and to be perfectly honest as long as I have a roof over her head, food on the table for her and clothes for her, I really don't care what I have or haven't got. (I can at least give her all the love in the world-and that costs nothing).

    Hi , we have sought advise from the cccs after finally giving in to our debts !! we are £28000 in the red mainly to the halifax by way of loans , credit cards and overdraft...
    we gave the cccs all the info but as far as we can see we have not been given a plan , just advise to send all our creditor £1 each !!
    how can we change this to a plan that the cccs can handle for us.

    Hi there

    Be grateful of a quick bit of advise on Right to Offset.

    I'm managing my own DMP, and one of the creditors was Sainsbury's Bank. They've sold the debt on to a DCA - I've received paperwork from themselves confirming the debt was been sold on, and similar from the DCA.

    I've still got current accounts with Halifax which I hardly use, but I need an account to use for household bills, rent etc. Given that the debt to Sainsbury's has been sold on, would the Right to Offset potentially no longer apply if I were to use the Halifax account?

    It would be much easier to use the existing account than apply for a new one somewhere, and the Halifax accounts are Faster Payments enabled, which is really helpful for bills. But obviously want to be sure before I make a move.

    Thank you for your post.

    The CCCS are in fact funded by the credit industry, this is common knowledge. I have attached a link to our website that explains about this in more detail http://www.cccs.co.uk/about/funding.aspx . Even though we are funded by the creditors, the advice we give is best advice for the client.

    I would recommend you seek advice from a free independent organisation such as CCCS, National Debtline and CAB as there are no fees with any of these for advice or services. The money you pay should go towards your debts, not to another company.

    Hi Patrico,

    A debt management plan is not always the best option for everyone. If you have been advised to offer your creditors token payments then sounds like there is not enough surplus at the moment for a debt management plan.

    If you were interested in a DMP you could look and see if there are any areas in your budget that can be reduced or see if you can increase your income in anyway. If you do managed this then call back for another review of your account.

    I have attached a link to a booklet that has a list of basic bank accounts. As long as there is no link between the banks and you have no debts with the bank then it should not be a problem.

    Hi Sarah,
    I have just checked and the 4 CCJ's are for 2 debts, not one. 2 relate to Capital one and 2 relate to RBS. The particulars of the claim state that the claimants claim relate to the fact that I agreed to pay monthly instalments, I didnt as I was burying my head in the sand and didnt reply to any letters. Interest is also going on at a yearly rate of 8%. I know I defaulted and I am willing to pay but is it correct for them to issue 2 to each of the debts? The charges are more than what the original debt was actually for in the case of Capital one. Any information such as what to say to the solicitor that issued the CCj's or the courts would be really appreciated.
