Excessive Speeding Fine - Can I Appeal?

    Presumably not a speeding fine, but a fine for not providing details of the driver under S172? She will get 6 points on her licence too.

    The fines are calculated under new rules, based on earnings - I guess if you're not there, then they have to make assumptions (unless she completed a means form?).

    If she says she sent the forms back, why on earth did she pleas guilty to failing to provide information?

    Just write to them with what you CAN afford per month - they are quite willing to accept monthly payments. I did this when I ended up with £260 of courts costs and £60 fine and they accepted quite readily.

    However, if you've never received the paperwork, you need to contact the court, so you can complete a Statutory Declaration and hopefully get the matter re-heard.

    We explained the circumstances in the 'guilty by post' plea, but it appears that they have decided the level of the fine with this in mind.

    The actual fine states that it is for speeding, rather than not supplying the driver details. As they received the initial NOP where my wife has admitted to driving, would that suffice?

    I also think it is highly unprofessional of them for not informing her if she now has points on her licence or not. The implications should she have an accident would again prove VERY costly.

    Thanks, Would they be happy with £10 (ish) per month do you think? With xmas looming, anything more would hurt. A lot!

    When I wrote I stated outgoings and oncome and (which left about £100-odd spare) and said I would be able to pay £32 per month over 10 months. They didnt look into income./expenditure too much, and didnt question it at all, so £10 is worth a go if you're skint.

    She then received the FOLLOW UP form they send out. Again, she filled this in and sent it off. It would appear that this is the form that was not received.

    (If you are still struggling to keep up, maybe you could find the nearest 8 year old child to explain).

    Thankfully, as I've read quite a few of your other posts, I won't take this personally. You seem to have an issue with everyone. Obviously that's everyone else's 'issue' though. Ha ha.:kisses3:

    They will inform her of any points when they return her license. I have 3 for doing 57 in a 50 zone (and to this day I swear they had not put up the 50mph signs on the motorway yet but obviously that'll never be prooved... I was only going as slow as I was because it was the speed ALL the traffic was doing... They must have had a field day with the old fines that day) and an £80 fine - When I got mine (just over the border in Wales so might be different?) I had to send my license with the second letter... (which I sent recorded as was paranoid about my license going walk about).
    The real issue is that she sped in a 30mph zone - this is a much higher fine from what I have heard then say a 50mph zone. The fact that she was more than 50% over the speed limit will not have helped either...

    As for insurance then until she has notification of the points then she can't be expected to contact the insurance company, however what she'll probably get is an SP40 - exceeding a passenger vehicle speed limit.
    If it's a dual carriageway she MIGHT get an SP50 instead... Exceeding a motorway speed limit. I don't think other than the extra points that they'll know how much she exceeded it by on her license. Judging by the high fine I'm guessing it's not going to be 3 points because she was so much over the speed limit...

    Depends on who handles the paperwork... and what mood they're in.
    They MIGHT accept a low monthly repayment, but you really should justify why you can only pay that much. And don't put down excessive figures for things - IF they query it then they'll not be amused if you have fibbed on the forms... and might request you pay it all at once - if you can't then they'll send our beloved bailiffs to collect and THAT adds more charges to the original fine. As for a comfy christmas... I don't really think that classifies as a valid reason for not paying the fine quicker than £10 a month... she DID speed...
