Excessive Speeding Fine - Can I Appeal?

Hi,

My wife received a Speeding notice back in May (47mph in a 30mph zone)which she filled in and returned. We then received the follow up which was again filled in and posted the following day.

We then heard nothing more until last month when we received a court summons for not providing details etc. We rang the courts and explained the above to them. Their advice was to fill in the courts paperwork explaining this and also send in her driving licence. She did this and filled in the 'guilty by post' areas.

The driving licence has since been returned with no explanation and today we have received a Notice Of Fine and collection order for £298 to be paid by 4th November!

£240 Fine
£15 Costs
£43 costs

There is no explanation as to why it is this much or whether or not she has received any points on her licence.

Is there anything we can do i.e. appeal, as we simply cannot afford this or feel we should pay this much.

    Do the crime pay the fine. The fine is designed to be a punishment, not an easy to pay thing. At least it will make sure the speed limit isn't broken again. Just to think the speedo will have been reading over 50mph in a 30mph zone, shocking. Be glad there's no custodial sentence, and there is no driving ban/license revocation is all I can say.

    Your only come back is if you feel you have evidence either that the offence did not occur or there is inadequate/illegal signs detailing the speed limits on entry to the zone leading you to genuinely believe the limit was 50mph.   • Thanks for the lecture - not quite what I was looking for!! You have obviously never done any wrong in your life and I can only hope to one day be as perfect as you - Saint Anewman!!

    The point I was try to make was that the fine is particularly severe - which the courts and police have both agreed this afternoon.

    We are not looking to get off the fine, but to have the punishment meet the crime.

    We have not even been informed if she now has points on her licence - which could lead to her insurance being void?

    Personally, I think 30mph on a dual carriageway, with no roadworks etc - which up until January / February of this year was a 60mph road - is ridiculous.

    Try reading the thread FIRST - it actually helps!!

    I'll do it s l o w l y for you this time. She received the NIP, filled in the details and sent it off - if I'm going too fast for you, just say.

    She then received the FOLLOW UP form they send out. Again, she filled this in and sent it off. It would appear that this is the form that was not received.

    (If you are still struggling to keep up, maybe you could find the nearest 8 year old child to explain).

    These forums are here to offer H E L P and A D V I S E, not to make ridiculous statements when you haven't even grasped the facts.

    Apologies to everyone else for the rant (including tomstickland - thanks) but I was looking for advise rather having perfect do-gooders gloating. AGAIN!!

    You will find a lot people are quite harsh and have no sympathy for speeding offence, I do think the fine is excessive related to the offence.

    Since you have filled in and returned the forms, I would contest the amount of the fine. Try your local CAB or pepipoo.com as stated by tom.

    From the harsh fine, it sounds as though the cops never received the docs you sent back. Since you don't even know yourself why this happened, i think it was a fair assumption to make.

    Your sarchastic inconsiderate posts do you no favours and you encourage people's smug posts.
