Accident at the Fair

Just a quick question really as I don't know where I stand.

I don't want to sound like a 'money grabber' but thought I would ask just in case.

Last night I went to the local fair, went on a ride, and the end of the ride, I left myself out and got off the ride. I looked down at my thumb and i had split the top of the thumb open - it was obviously done when I removed the safety bar.

After I had told the man who was in charge of the ride what had happened he got all funny about how I shouldnt of done it - but all I wanted was a plaster!! I went and found the first aider and got it cleaned and bandaged up.

Now I have to go to the doctors and get a tetnus injection as god knows what could have been on that metal pole - so that means time outa work!

And also, there were no signs on that ride saying that I couldnt let myself off the ride.

Where do I stand? Could I claim anything or sue?

  • I doubt it - those travelling fairground rides are dangerous and the owners difficult to track down - I always thought that was fairly common knowledge. :confused:

    At the fair which comes around near us they had a ride which went upside down and yet the safety harnesses used to come open in mid ride, the glass capsule you rode in was cracked too. It was banned on the third year of this being the case! :eek:

  • thanks. well they are still in my town at the minute, will be for another 2 days, and they are same ones who go to a near by fair every year - so surely it cannot be that hard to track? I know they are dangerous but surely must have insurance for these rides?

    Thing is how would you prove it happened on that ride? If you're genuinely concerned about the safety of the ride then report it to your local council - they are the ones who issue permits for the fairs and will check the safety issues...

  • I have witnesses that saw it happen and I spoke to the man on the ride, and told the man on the other ride who cleaned me up. Do you think that would be enough to report it?

    I think that we may live in the same town, I was at the fair on Tuesday evening in all the rain :(

    I would have thought that they would have insurance for these rides but I can imagine that it would be hard to get details from them to make a claim also they may say that you shouldn't have removed the safety bar yourself therefore say it was your fault.

    Unfortunatly we arent in the same town as it opened last night. He did tell me that I shouldnt have removed the bar, but there was no sign there to say that I shouldnt. thanks :)

    If you think it's dangerous report it to your local Health and Safety so someone else doesn't get injured.

  • I will, I will let them know. But from the claiming side of things.. u dont think theres anything I can do? Just asking, as if I can, it would have to be done before they leave.

    Ask the H&S people, one of the things they will be checking is the proprietor's insurance. But have you considered what a cut on the thumb which only needed a sticking plaster would be worth in cash - £5, £10, £20 ?

    You want to claim for a cut thumb? How long did you need off work to get a tetanus jab? Could you not have gone in the evening?

    If your thumb was that bad, you'd have gone to A&E and had the tetanus shot at the same time (in the evening).

    If you really are considering a claim (I can't believe you are), then you will need medical evidence.

    But really, isn't your primary concern reporting it before someone else gets a cut? After all, it could be a haemophiliac next time! :eek:
