    Has the world gone stark raving bonkers- don't answer that I already know it has! Sueing for a cut thumb! If you got a paper cut flicking through the argos catalogue would you sue them!
    As for time off for tetanus injection, I believe it's something you're supposed to keep up to date anyway!
    It makes my blood boil seeing things like this! If everyone took this attitude we wouldn't be able to do anything because everyone would be living in fear of being sued! Insurance premiums would go through the roof because the amount of payouts would get ridiculously out of hand.
    Don't get me wrong if there's serious safety breaches going on and there is a real danger to people then do the right thing and report them. Suing serves only one person and that is yourself.

    Hello everyone, I am Mr Mix and I have read this topic with some interest because I own travelling fairground equipment.

    To Secret Squirrel, the person you spoke to that was less than helpfull, are you sure it was the owner of the ride or could it have been the operator? It is very possible that the ride owner was the man who actually helped you. If you were dissatified with the help you received you could have asked to see the funfair organiser.

    To others that have posted, just because you don't know where a travelling fair was/will be before and after it visits your town doesn't mean that they are hard to trace, it does mean that you need to ask a question, a question that I can answer for you. If the fair was on your local council ground then they will have the name and address and telephone number of the lessee, this person will have been in overall charge of the fair. if the fair was on private land then the landowner will have the same details. Failing that you can contact The Showmans Guild of Great Britain if it was a modern fair or The Society of Independant Roundabout Proprietors if it was an old time fair, about 95% of all fairgrounds are run by members of these organisations, failing that there are two other organisations that could be contacted.

    Re insurance, all adult rides have to have £10 million pounds worth of public liability cover, this would have been checked before the ride was allowed to open.

    Re safety, all rides have an annual safety test which is basically like an mot test, it involves three parts, electrical, mechanical, and a non destructive test which is a test similar to that which aircraft have to test for metal fatigue at vital stress points. When all three of these tests have been passed a certificate is issued for twelve months. This certificate has to be produced along with the insurance certificates.

    Further to the inital safety test, especially at council owned property, a health and safety offical, appointed by the council, would have attended the fairground and conducted his/her own tests and checked all the paperwork before giving thei consent for the fair to continue.

    If anyone would like to know more then please feel free to ask and I will do my best to answer.

    It also could have been some local worthy only employed on a cash in hand basis for the time that the fair was in town (as happens in most towns)

    I would agree with this. Everyone sees the people travelling with the fair as money grabbers and not willing to help anyone, but in actual fact the money that they have to pay out for this insurance is an enormous amount of cash. Yes they may make it back in fees for the fairground rides but the cost of insurance is rising all the time which results in the higher fees for a ride. If you don't think they are worthy then why attend, never mind go on the ride. if I went to Alton Towers and suffered a cut I wouldn't even think about a complaint.

    Also, if the OP was so concerned about the incident would they not have attended A&E that same night to get the cut looked at and get a tetanus injection. I know I would. Any any employer worth his salt would let an employee attend a doctors appointment without it impacting on their wages etc. I'm sure I would find someone to complain to if it was me and I was not allowed to go to the quacks.

  • Just a quick question really as I don't know where I stand.

    I don't want to sound like a 'money grabber' but thought I would ask just in case.

    Last night I went to the local fair, went on a ride, and the end of the ride, I left myself out and got off the ride. I looked down at my thumb and i had split the top of the thumb open - it was obviously done when I removed the safety bar.

    After I had told the man who was in charge of the ride what had happened he got all funny about how I shouldnt of done it - but all I wanted was a plaster!! I went and found the first aider and got it cleaned and bandaged up.

    Now I have to go to the doctors and get a tetnus injection as god knows what could have been on that metal pole - so that means time outa work!

    And also, there were no signs on that ride saying that I couldnt let myself off the ride.

    Where do I stand? Could I claim anything or sue?

    umm .. i would put it down as an accident, if you were that concerned about your cut thumb you would of gone to a&e immediatly for your tetnus (if you are not up to date with your jabs) and not carried on with your night at the fair. you wrote this at 2.48pm you could of gone to a&e this morning ? ? is your cut thumb effecting your use of the pc ?

    i agree with perious posters, surely your concern should be reporting the dodgy latch.

    hope your sore thumb gets better soon. out of interest what do you think you could sue for ? ?

  • Hi I know this thread is a couple of days old now but just read it and need to comment.

    Op, you cut your finger are you serious about claiming compensation? Some of us have really been through life changing accidents and got a small sum of money which in no way compares to the pain you are put through. If I could sue my work everytime I got a papercut I would be a millionaire!

    I was in a serious car accident 7 years ago and nearly died, I could not work for a year, was in so much pain I barerly got out of bed and am still on morphine every day yet still in pain despite it and there is no end in sight. I had post traumatic stress which gave me up to 7 panic attacks a day, nightmares at night, I went through a pair of pyjamas every other night because I was dreaming it was the seat belt holding me in the car and I was trapped. It ruined my life, not my life in total because despite the pain you adjust and your life changes but it ruined what was going to be my life at that time. There is so much I cant do because of the accident.

    I got £20,000 and it took me 4 long years to get it, I was living on around £40.00 a week in benefits at that time cos I live with my parents but still paid board, I got into debt because of it. Of the £20,000, £15,000 of it was loss of earnings which paid off my debts. This is for an accident that nearly destroyed my life, what do you expect to get for a cut thumb? I know that money is tight these days but do you seriously expect to get something out of this? Even after the accident I didnt think about compensation until the insurance company called up (i didnt drive at the time, was front seat passanger) and offered me £500!!

    I would pay back the £20,000 plus give everything I had if I could have my health back in return. I know this post probably seems harsh about the op but wanting to claim for a cut finger just belittles what those of us who really do need and deserve compensation go through.
