  • Hi Queen, sorry if I've missed this in another thread, but are you both going BR, or just one of you? If it's just one you could get the car put in the other's name, then the OR wouldn't have an interest in it if it's your only vehicle, I don't think. Correct me if I'm wrong! ;):D CBx

    Chelseabun, most OR's will have a very dim view of this as you, in effect, disposing of an asset. I know Stevelinz said he told his OR and they were fine with it, but it's usually a big no-no.:D

    I think it was because the OR had a deep dislike of bailiffs, At least we had something in common

    Could I sell the car to my parents I oew then approx 31500 they have been helping me out and they will have to lend us the money to both go BR which in total will be about £2800 to clear they have then said that my OH can use the car for work would this be acceptable to the OR, also about bills we have mobile phones which we want to keep my OH has a phone on contract for my son e who will be paying for this we cann't reduce contracts any more than what they are, also sky will they allow the min package and internet do they allow this
  • To give you an idea this is what happened to me on thursday...

    I have two cars between me and my O/H

    Car 1. 1963 vw beetle which is a total project not roadworthy not taxed mot'd insured or even registered in the UK!
    Value is about £800 if put back on the road but as it has no paper work it is essentialy scrap so bout £180

    Car 2. 2004 ford fiesta tdci had £3100 finance outstanding on the car. Parkers vlaue on it was £2900 in poor condition.(its not but thats what the OR based her numbers on) was paying £101 a month on it.

    Car 1 is being taken by the OR and I can keep car 2 and the finance has been put into the Bankruptcy so i don't have to pay for it any longer!
    So i get the car and have to pay nothing.

    I will be buying my beetle back as it is very precious to me.
    But it just goes to show that value isn't always that important its what its used for and on how nice your OR is and what they base there figures on.

    Can I ask something probably stupid here, when do you discuss your car with the OR. I know on the day in court I will have a phone call in the court in a room with the OR, do I mention my car at that point and my new bank account, I am told the OR will have no details of the case in front of them as they will still be in the court house?:confused:

    The last thing I want to do is pee the OR off the first time I speak to him/her, but I feel a bit nervous about what I ask at this point, can someone who has been through this stage please give me some advice, this is not the interview I am told that is usually face to face later, not sure if I get that date on my phone call with them or what?:confused:

    I know the car is a grey area, in the parkers guide does the OR look at the private prices, ie private good and poor. :confused: If so mine is not in brill nick so looks like £950 and to be honest with the state of car sales I reckon it would be pushing it to even get £950.

    Sorry that is more than one question!

  • I was very worried about our cars, but our OR was very nice about it and, as soon as I mentioned the cars, he said he was exempting both - DH's car is worth approx £2,500 and mine is worth approx £650.

    The OR's reason was that a car can be exmempted for work or vocation and, although I'm not working, I am a student which he considered to be a vocation. DH's car is used for work and he has 3 payments outstanding on an HP agreement which he has been allowed to continue paying.

    As others have said, I think it's all down to the OR on the day. I know of 2 people who have gone bankrupt recently. One who didn't work and had 3 children, was not allowed to keep her car and the other who also didn't work but only had 1 child was allowed to keep her car - very inconsistent in my opinion.
