Hi, forgive my probably ignorant question. I've read a huge amount about refunds and Section 75s on here but still can't work out what I should do.

I booked 6 flights with Ryanair and paid with a credit card. They were for me, my daughter and my boyfriend to have a weekend in Spain to celebrate his birthday. We've since broken up, and I have (in an amazing bout of rotten timing) lost my job and have found out I have to move as the tenancy has expired on my house. So, I really can't afford to go away now, even if I still wanted to (which I don't).

Ryanair don't give refunds, so I'm hoping there's a way I can get the credit card company to refund it. What do I have to do? Does this count as a section 75 claim? Is there something else I can do? Or am I going to have to accept that the £345 won't be seen again?

    TIA,

There isn't a breach of contract issue here with the supplier, ergo it doesn't count as a Section 75 issue.

Read the terms of your holiday insurance you might be able reclaim a portion of your costs

Thanks. Yep, that's what I figured. Travel insurance says it doesn't pay out if I cancel the trip. Poo.

    Thanks anyway.

Losing your job is usually classed as a good reason to cancel although depends on your policy

Have a look under the cancellation and curtailment section of your policy to see if you are covered.

I had a good read, but it seems I would have needed to be there two years, which I hadn't quite. Not to worry.

    Thanks for your help.

  • Hi

We have recently been contacted by a company calling themselves Timeshare Mediation Services.

About 3 years ago we bought 4 weeks timeshare(stupid I know) from Lion Resorts using my credit card for the deposit.

Timeshare Mediation rang this week and said that Lion had shutdown 3 of their 4 resorts and, as a result, we were entitled to a refund under Section 75 of the Consumer Credit Act because Lion had failed to fulfil the contract.

They will get that refund back for us for a fee of £300+.

Is it easy enough to do myself and has anyone heard of Timeshare Mediation? I've checked them out on a credit scoring company and they were only incorporated on 20th May which is what's made me dubious about using them.

    Thanks

    Linda

If it's true what this company says about section 75 ( the reason I say true is there may be a time limit) then the first thing you need to do is contact your credit card company, Don't pay anyone, do it yourself, they will send you a form to fill in easy peasy, one thing that might not be pertaining to section 75 is that the company still has one resort open, so they are not Bankrupt, so not sure if you can claim, but it all depends on your contract with the company, as I said first port of call is your credit card company
  • Thanks for the reply.

Although they haven't gone bust, when we took out the deal they were offering holidays in 4 resorts and now they only have one. It was never our intention to go to Majorca more than the once and I can back that up with email communications to/from them.

I'll contact my card company tomorrow and take it from there.

    Hi all,

I purchased some furniture from the rogue traders Wimbledon Pine back in about September 2006, I can't remember exactly when because the credit card has since been closed and I have no statements etc pertaining to it. The furniture never arrived and despite attempts to get my monkey back through the company, I received no refund. Am I still able to make a Section 75 claim?

I've just sent off a S@ction 75 claim to T@sco credit card for a summer house that leaked and went mouldy within 5 months. I was advised by Tr@ding Standards to make the claim as I had tried to resolve it with the people who supplied and fitted the item but they stopped acknowledging my letters.

Can anyone who has been through the process advise me how long this process usually takes? And do they normally deduct some money as we used the item for the 5 mths?

    Thanks
