  • Hi all,

    I ordered a car through a company to another supplier. The supplier may not be able to deliver when I need it. This has to do with Tax laws and export. Either way, I ordered it through the one company and it is that company that I also paid to and not the supplier. Am I therefore still covered by Section 75, being that the company who took the deposit is the company I have actually dealt with? I have been very specific with the order company regarding the final acceptable and legal date for delivery. they have been telling me up to now that the car is OK and being made to specification and would be on time. Now they are saying that the car may be late and as I would then fall outside of the tax free agreement entitlement, I may have to pay more. I feel this breaches the contract and that they should either cancel the order and pay me a full deposit refund or waiver the extra charges as I ordered the car in good faith under the assumption they would deliver in good time as they stated at the time. They say as the car is made to order, so I will lose the deposit if I cancel. Any thoughts and information is appreciated.

    I purchased a used car and part paid with my credit card. The car developed faults after six weeks. The garage haven't honoured the warranty and I've paid £880 in repairs. Can I claim this back from the credit card?

    what are peoples dealings with Capital one? i have bought a car through a dealer 4 engine breakdowns in 4 months, each one quite costly luckily covered under a warranty scheme but dealer is being less than helpful, offered to buy the car back at half the price he sold it and latest is a letter of his solicitors, have started the process with capital one 3 weeks ago, but only received a letter of acknowledgement is this the norm?

    My S75 has been found in my favour with a final decision from the FOS. The finance company have not been very helpful, stalling and not corresponding through this. This was awarded to me last Tuesday. I have not heard anything from the finance comp. I called today to liaise with them and already they are stalling, "she is on the phone" "call you back" (no call) now I'm aware today is only a week on and it's 12:10 in the afternoon. I don't expect they will call any day. Advice needed if they continue to ignore me and what to do. I had to write to the CEO on the first occasion as they do not like talking to me. Also my name is known at the head office as this is a Pip implant refund (please no judgement)
    Any help would be appreciated. P.s I know I need to be patient , but their track record makes me concerned.

    New here and need help or guidance:
    Using her Natwest DEBIT (Visa) card, my wife booked 2 round trip flights both London to Tenerife. One for October 2013 and one March 2014.
    My wife died in May this year :( :A and Thomson Flights say that they "Don't give refunds on flight only bookings"
    Yes, she had insurance but had a "pre-existing condition" which was apparently excluded from cover. I've written to Natwest requesting that they use chargeback (section 75 ???) - no response from them after 1 month.
    Total cost of these flights over £600 which I NEED to help with all the expense of funeral etc. Anything else I should do? Should I expect any sort of success via Natwest?

    Hi

    I used my credit card to a make part payment of £8k towards building work which cost in total just over £60k.

    I wish to apply for S75 because the building work was not delivered on time and has still not been finished properly despite the completion date being in Sept '12. Many faults appeared during the snagging stage due to substandard parts and poor installation.

    Having read the S75 article does this mean that because the total amount is over £30k I'm not covered at all? Or only up to £30k or just a £8k refund?

    Any advice is more than welcome.

    You are correct in your "because the total amount is over £30k I'm not covered at all?", statement, as you are outside the limits, (between £100 & £30000), I am afraid S75 will not help you.

    Sorry for your loss, but if your insurance excluded your late wife's illness then you have no claim there.

    If Thomson Flights T&C's are in existence then you have no claim there.

    Chargeback won't help as the flights are/where still available.

    If you "NEED" help with funeral costs, there are grants available for this

    My parents used their credit card to purchase 2 mobility electric beds costing over £4000. In the first six months there was a number of faults with one of the beds eventually leading to one of the beds stopping working completely. As there had previously been several minor faults with this bed they asked the company for a refund quoting the sales of goods act. The company refused, my parents had an independent report confirming a fault, so thinking they were covered on the credit card they applied to the card company under Section 75. The card company refused and referred my parents to the Ombudsman. Having spoken with the ombudsman and quoted the joint liability under S75 and sales of goods act the ombudsman hasn't yet ruled but in the conversation the ombudsman said it would be unlikely they would receive a refund but would most likely approve the bed to be repaired. Is this right?
