Section 75 refunds - article discussion

  • purchased an android tablet via Ebay October 2012 using Paypal from a seller Superslim-HD - this item included a 12 month manufacturer's warranty. Item has now broken and have been trying for two weeks to contact the seller, first via Ebay, via their website and then an email I received from their customer services. They are not getting back to me. Have spoken to Ebay, Paypal and the Bank - no-one can help me because of the length of time between sale and now. Could Section 75 help me?

    I bought a pc from a catalogue simply be so could I be covered if
    i was made redundant and couldn't pay and have fallen behind with the payments as a result I would have paid from a nationwide flex account card or possibly my wives natwest card.

    I'd appreciate a bit of assistance on this one;
    My car broke down, local garage said it was head gasket and recommended instead of fixing it that I sourced a second hand engine, which I did. They told me they would charge in the region of £1200 inc VAT to fix my engine but as it had 97k miles on it they recommended the second hand engine path as it would be cheaper.

    The engine cost £800.
    The long/ short of it is the garage took a month and half to fit it and not once called me to tell me about progress - they even swore at me when I turned up in person as they hadn't called me as promised for the umpteenth time.

    Along that journey they showed me the engine wasn't firing on the 4th cylinder, but this apparently was fixed before I got it back. They then presented me with a bill for £1200 for fitting the engine, which I paid under duress.

    You'll have worked out now that £800 plus £1200 is much more than the original £1200 they quoted me for fixing the original engine!
    The car has now broken down, the 4th cylinder not firing.
    The garage said 'it was working when it left here' and want nothing to do with it. They have already as good as admitted they didn't know how to fit the engine as it was of a type they hadn't worked on before (they could have told me that at the beginning!)
    The second hand engine supplier appears to be more understanding and have offered to look at it but will charge me if it turns out (as I expect) the garage have made errors in fitting the engine.
    In fact along the journey the supplier offered to call the garage (and did so 5 times) to offer assistance to the garage to put the engine in - each time the garage refused to talk to them, saying they knew better.

    So I'm seeking to find out whether I can play the Section 75 card here so I can get some/ all my money back so I can pay for a more reputable garage to fit the engine.

    At the moment I'm £2000 down on a car that is only worth apprx £3000, so unless I can get that money back to get another garage to fix it properly, then I'll have to scrap the car.

    Advice much appreciated.

    Do you need to return faulty goods if you activate Section 75?
  • I purchased a bath 18 months ago on a Tesco MasterCard. The whirlpool jets are now suffering from peeling chrome. The company supplying have recently gone into liquidation. Had they not, the bath would still have been underwarranty.

    Tesco are insisting on an independant report from a VAT registered company as to the fault - despite colour images having been sent. Naturally, the larger VAT registered companies are reluctant to do this and I am having problems in finding such a company who will do the work. I have found a smaller (non-registered) firm who are independant and will conduct the examination, report and costints, but Tesc will not accept this saying that they will close the claim if I do not supply what they want in ten days.


    Can they place these conditions on the claim as it seems a restrictive practice?

    I may have a claim about something under s75.

    I rang the Citizen's Advice Bureau for help and they didn't know what Act my problem would come under so they told me to ring the Consumer Law Service. They were really helpful and pointed me in the right direction and told me about template letters for s75 claims which are on their website.

    Looking at the last page of posts on here, it doesn't look like people always get a reply but they would probably benefit from speaking to the Consumer Law Service.

    If it helps, the number is 08454 04 05 06.

    Ask Tesco for a "Final response" letter, then escalate to the Financial Ombudsman Service,

    That number is for the Citizens Advice consumer service and can be contacted via 020 8185 0710, instead of the rip off 0845 number, or freephone, (from a landline), 0808 1566032, or,0808 1561036.

  • Hi,

    i bought a wooden floor from an online retailer and their site recommended a self adhesive underlay to install it. i bought the underlay on this recomendation and got our builder to use it.

    the underlay was completely useless and did not hold the floor in place as i assumed it would. we have had to take the floor up to re lay it using proper adheisive but not we cannot get the underlay off the wooden planks. this makes the flooring un-useable.

    i contacted the retailer and they are completed uninterested stating that 'i choose' the underlay and that it has been used by many customers in the past. they are determined that this is not their problem and want nothing to do with it.

    Am i able to claim from the credit card i used to buy the flooring? it cost £1400.00.

    Hi,

    I'm looking at booking up a stay at a Disney hotel in Florida (just hotel and park tickets, will be booking flights later) through Kenwood Travel. If anything were to go wrong I was wondering if this would be covered under Section 75.

    The deposit is £100 each so as I understand it, the purchase would qualify. I cannot imagine Disney going bust, but what if Kenwood Travel were to? As the purchase would be directly with Kenwood Travel then it would be covered wouldn't it?
