    Section 75 or chrge back?
    I purchased a Kindle Fire HD 8.9" when on holiday in the Florida. The Kindle was bought at Best Buy (a major retailer). I was actually looking at the Apple iPad mini when I was shown the Kindle. I now suspect that there weren't any minis in stock as the sales associate went out of his way to get me interested in the Kindle. He assured me that there were over 40,000 apps I could download and that it would work perfectly well in the UK and was fully supported by Amazon.com

    Well on setting it up I found that I can't download/purchase apps, music, video and the news stand is non existant. After contacting Best Buy via their Facebook page I was told that the associate had given me the wrong information and the Kindle I had purchased was not supported in the UK. They gave an email address to send all the information to ie. store, cost, purchase date etc. I have not had a reply and that was over two weeks ago.

    I also emailed Amazon.co.uk for advice as I thought there may be some kind of 'setting' I could alter or download to make the thing work properly. They couldn't help so they suggested Amazon.com. I had an hour on 'chat' with one of their customer support staff who eventually found out that the Kindle would only work in the US and for someone who had a US credit card and billing address.

    I now feel that I have done everything I can reasonably do to sort out the situation. My Kindle books (I have an ordinary 6" kindle) were delivered as soon as I registered the Fire. I can't get anythng else on it. The cost of this was $320.99 (approx. £202) so it is a very expensive e-reader only. Obviously I was misled by Best Buy, but where do I stand in relation to making a Section 75 refund claim from my credit card comapny?

    Any information/advice would be much appreciated.

    I've followed all the advice following the purchase of a Levono computer from a retailer but Lloyds Mastercard keep telling me that section 75 applies only to a misrepresentation and breach of contract. In my case, I bought a next day onsite warranty with the computer, all paid via one transaction, and when the computer went wrong (an hour after I got it), technical support would not come. The retailer told me in no uncertain terms that it had nothing to do with them. Eventually, a Levono engineer was sent with a new motherboard but when he rang the office, they told him not to install it. Then they wanted to send me a graphics card for me to install (very onsite but haven't a clue how to install components and keep me safe), and after that, no amount of requests resulted in anything other than an offer of a replacement. I refused that on the grounds of my appalling experience with tech support. I had had a month's chasing up and largely unsccessful dealings. It was enough.

    I've paid for a hired laptop, an engineer to check the monitor (it kept switching off) and another opinion, i.e. consequential losses above £100. Advice is that I can claim for those but Lloyds are not convinced that there has been a breach of contract and they want me to resolve it. I've tried that but keep being fobbed off.

    Good, old banks. Don't you just love 'em.
  • Hi, my mother and father had a timeshare appartment in Tenerife and they were conned into getting involved in the notorius scam called Cashback Europe. My father sadly passed away in October last year and had every intention of making a claim under Section 75 for misrepresentation but, never got round to it. The deposit for this scheme was paid on his credit card. My mother was a joint secondary card holder on this account. What I would like to know, can my mother still make a claim under Section 75 even though my father is deceased or, can it only by the primary card holder who can make the claim?

    Is there any protection clause for something worth less than £100 bought with a credit card?

    Chargeback,not as strong as S75 and only covers for faulty items or not turning up, you only have 120 days to contact your bank about it and the card has to be VISA,although I think Mastercad have similar in place.

    We bought a conservatory last April (deposit paid by CC) there has been a catalogue of problems with it since starting - we tried to do the right thing and in the first instance asked the company to put everything right, in the end we went to dgcos but we still have not been able to use the conservatory and now they have finally agreed that there is moisture/damp/water ingress - so my question is can I claim under Section 75 please?

  • Hi, I signed up to have my conservatory replaced by a reputable compnay and got credit through the conservatory company via black horse, paid a 2k deposit. I signed off plans etc - the issue is that the company are now saying the work is now going to cost an additional 1.5k to complete - what would the best course of action be - I have spoken to the company and they are only offering to knock another £200 off the price...they are saying they are doing this at cost, and that the issues which are cuasing the increase could not have been known at the time the price was agreed....

    Any advice appreciated?!

    Anyone know how to prod some response from Tesco regarding a Section 75 claim?

    My claim was as a result of an ebay purchase that went wrong. The ebay Customer Support team decided in my favour, saying that if I returned the items to the seller I would have a full refund. Unfortunately for me, I was out of the country at this time, and the ebay time limit expired.

    I then wrote to the Tesco Bank (recorded delivery) making a section 75 claim enclosing all the relevant photocopies. This was weeks ago, so far with no response.

    Is there anything else I can do?

    Can I assume EBAY also means Paypal if so I would bet any response you do get would be to state that it doesnt meet the criteria for a Section 75 claim and unfortunatly they will be correct.

    I might be wrong as I do not use Ebay but I didn't think there was another way to pay other than Paypal, but if there is and you paid direct to the seller then you should be covered. In which case you need to write a letter to the complaints department of the bank.
