    Hi to all,

    I recently purchased a DVD player (£450GBP) paid by way of PayPal gift with my M&S Credit card but the player is not as described and has some faults.

    I've asked for my money back but the seller won't pay up but can claim for a chargeback through my Credit Card using section 75 ?

    The seller is a trader on eBay and has his own traders website.

    I've read the blurb but I'm still not sure..

  • Hi everyone,

    after six months of hassle trying to get a section 75 refund for a tv that I bought online which was faulty, I eventually got good news that they are going to settle the claim. They have told me to give the tv to a charity shop ..... my question is, does anyone know of a worthy charity where it will actually go to a person who needs it, rather than the money just going to the government? I had a letter from a charity shop that I had given loads of stuff to and it said most of the proceeds went to the government, so I won't be going into that shop again!

    Get an independant report to back up what you are claiming. Thats the fastest way to resolve your problem. Standard procedure for a Section 75 claim.

    The seller says one thing, you say another. You have to be able to provide evidence of what you're claiming.
  • I've booked some flights for a family of four a few months ago (£3,200) with Thomsonfly and have now seen that the price has dropped considerably (now £2,500).

    I would like to cancel and book re-book at the cheaper price but they tell me the flight is non-changeable and non-refundable.

    Would anyone have an advice on whether this is worth pursuing?

    It's always worth looking into this at the time you make the purchase as that's when you're in a strong position (i.e. you can walk away). If, as you say, the holiday is non refundable then it appears your options are severely limited.

    Just looking for some advice before I book our summer holiday.

    What is the mimimum amount you need to pay on your credit card to be covered by Section 75?

    Looking to book a tailored package holiday via Hayes and Jarvis (part of Thomson), which includes all flights, hotels and transfers.

    The total of the package is over £2000 with the first deposit being over £1000.

    I would like to be covered under section 75 but don't want to pay the full amount of the deposit via credit card, as there is a fee of 2.5% for using one. So my idea is to pay the minimum amount possible via credit card (say £10) and then pay the remainder of the deposit and balance via debit card.

    Would we be covered for the entire holiday? or would I need to increase the amount I paid on credit card.

    There is no S75 protection for business transactions - so no you cannot get your money back this way.

    I have been trying to claim under Section 75 for just over a year now for a faulty tablet bought from Jexaa. I tried repeatedly to contact the company then gave up and put in a claim with Tesco Credit Card Company. This is proving extremely difficult and to date has taken over a year. They keep asking for the same stuff - proof of purchase, emails, independent report on fault.
    I have sent them all they have asked and have paid for 2 different reports - both of which say the tablet is faulty - but that it cannot be accessed because the fault makes it power off and you can't get past the screen lock.
    Jexaa have a quite a list of complaints on the web and I feel stupid to have used an unknown company - but I did think that I was protected by my credit card. The tablet cost £200 and the reports a further £40. Now Tesco CC want another report.
    Should I pay for another one or are they just trying to fob me off so I don't get anything back.
    (PS The tablet came in a damaged box and NEVER worked properly - I am pretty sure it was one they had tried to, but couldn't, recondition so just sold on to stupid old me!)

    Please could ANYONE advise me further on my rights? Thanks :)

    Anything, even as little as £1.00,(or less), this then gives S75 protection or the whole of the transaction as long as the transaction is between £100.00 & £30000.00.
    So £1.00 on the CC will only cost you 2.5p as the percentage charge.

  • Hi guys just after a bit of advice.

    Long story short... I bought a phone from O2 in November, I returned it beginning of January as it had developed 2 faults that I felt were unsatisfactory due to its cost and age (just under 6 weeks old when i returned it). I was met with a very stern, miserable lady who was fine up until she saw it was outside of O2's 28 day return policy. She then went in to hyper nasty mode, and told me and i quote "It's no longer O2's responsibility, we aren't liable for the phone anymore the manufacturer is resposible". :eek:

    I immediately got on the phone to my credit card company (Vanquis) and explained what had happened. They put in the claim, I received a form within a few days which I returned instantly. about a week or so later they called and asked if I could provide some proof that O2 would not take the faulty phone back. So I did, sent it to them and a few days ago they credited my card with the full amount!

    My question and concern is now this, in the letter I received it says under VISA regulations the retailer has 90 days to challenge the decision. If they do, and they are successful then the full amount will once again be taken from my card! :eek:

    So, I have a faulty phone which I want to replace. I have got the money back to purchase a replacement but I am now too scared to spend it in case the decision is overturned and they take the money back!

    Any words of advice would be greatly appreciated! :D
