Please help me

Can someone please advise me?
A few days ago I brought my son a football kit from Sport Soccer/Soccer World / Sportsdirect..they seem to go under all 3 names. When I brought it I asked the girl why they were £10 cheaper than their other shop down the road. She said she didn't know why and they had always been at this price. I also asked her what was the largest size.She said L which was aged 6-7yrs.
As my son is nearly 7 I would have preferred to get a larger size but to do this I would have had to by all the peices separatelty at a cost of £ 50 ish I was told.So I opted for the 6-7yrs knowing that it probably would only last him 6 months.

I got home only to find that it did not have the sponsor name on it !One of the reasons I was so keen for him to have the new kit is because the sponsor is ACORNS a local hospice and as I work with children with cancer it seemed an importnat thing to be supporting.

I phoned the shop and was fobbed off saying that they were still being sent the older stock without the sponsor where as the shop down the road was getting the newer stock. I suggested that maybe this was the reason that theirs were £10 cheaper and maybe they should advice customers of this. She said I should have noticed when I brought it.To be honest I would never have dreamed that it wouldn't have had the sponsor on!

So I was told that as their policy was exchange or credit note I would not be able to get a refund. They did agree though that I could see if I could exchange it at the other store.

In the meantime my son , desparate to wear his beloved teams new kit said he didn't mind not having the writing on it and pleaded with me to wear it. I agreed and thought that I would take it back to the shop and ask them to put all the lettering on pehaps for free!! So all ok I guess,untill....

Yesterday my friend went to the "other shop" down the road and brought he same kit ( with sponsor) in a larger size for her son.In fact the largest size they do is a 7-8yrs. Perfect for my son!!!

Fuming now I phone customer services only to be told that because my son has worn the kit there is nothing they could do but offer their apologies. I said that I thought this was outrageous that I had been mislead and told things that weren't true. He said that different stores sell different sizes. I am sure other shops all sell the same sizes and if they don't they would let you know.

He then calimed that in fact they didn't sell the bigger size I said my friend had brought. I said over and over again that I had seen the kit and the bag that it had come out of and it was definately right.

So what I want to know is am I fighting a loosing battle. I think I have been mislead both about the sponsor and about the sizes. Is their absolutely nothing I can do because my son has worn it??Please help. I will give up if you tell me to!!!! The man I poke to refused to give me an adress or name of anyone I could take it further with.

    I'd have to say your mistake was in letting your son wear the kit. You're not entitled to a refund, nor were you before he wore it. Most shops have an exchange or credit note policy for 28 days. As that is usually part of the contract when you buy it then you would be entitled to that, however the item must be in the exact condition it left the store and that would clearly not include a worn item wether it has been worn just the once or not.

    give up. you've made a mistake (we all do it) by letting him wear the shirt.

    buy him another shirt with the sponsors name on it.

  • You can normally only return items in the condition they were sold in - which it wont be if its been worn - especially by a 7 year old!

    Sorry, but it looks like you are not going to get thier money back.

    They have been a bit underhand, but there isnt much you can do now.

    It says this in the store aswell :S

    So how is it their fault (Everytime I go in they always seem to have old kits never the brand new ones) that YOU bought the kit, YOU allowed your son to wear it?

    Yup, go for the sympathy vote. You really shouldn't have let your kid wear it, but explain that you'd already given it to him before you noticed it had no sponsor, and taking it back off a 6 year old would have been really cruel, and resulted in tears! (I'm thinking back to my brother that age and his Arsenal - bleugh! - kit, and the second he got it, he would have howled if it had been taken back off him!).

    So what if his mum bought him a dodgy-knock-off-last-seasons-kit from the pound shop just to save a few quid, his mates won't take the mick......surely :)

    a. You should have checked the kit prior to purchasing.

    b. You should not have let him wear the kit (which means you could have had it refunded and perhaps used the credit note at the other store to help fund the sponsor logo'd kit)
  • I wear my first teams 4 year old top at the club I support now. They both play in similar strips and i am known by my first clubs name on the terrace.
