Parking ticket in Asda car park - Is this legal, can they take me to court?

I don't remember the OP saying he went to football only that it was a football match day. Supermarkets sometimes cut the hours you can park on these days.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

Are you SURE it was enforceable, Bluejake? Bolton Council are well-known for having wrongly marked bays, and wrongly worded notices. I'm sure you checked it very carefully before you parted with your cash, though!
Bolton Council were taken to court by one guy over a parking fine he received. He won the case and opened up a loop hole for anyone else in the same position to request their fine money back as the parking spaces apparently are not to the size they should be and are too small.Wow, I got 3 *, when did that happen :j:T:p
It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted

The police did an undercover operation earlier this year as they knew they had a problem but not as big as they found it to be. In the first 2 weeks they got approx 100 fraudulent users so they extended it and they were working on this for approx 2/3 months. In total they found about 300 people using the badges for fee parking but approx half of these were actually council workers. They were all taken to court where a small number pleaded innocent so had to wait for another hearing and i think a couple were found not guilty, how I have no idea as they must have been using another persons badge to have been caught. They were all fined in the region of £150 plus court costs. The badge hold can actually lose their badge from someone doing this whether they are aware of it being used or not, A very selfish act to save a £1:rolleyes:Wow, I got 3 *, when did that happen :j:T:p

Thats correct if you badge is misused it can be taken off you. We have a blue badge but its not for me but for my daughter, I only ever use it when she is with us. I often find there isnt sufficient spaces and have to use a normal space which makes it hard for her to get out of the car. I been told I can use a P&C space but I dont like using them as it should be for young children
The photo on the blue badge isn't shown when you park the other side is. Despite what some people say I found it hard getting a blue badge for her and its only valid for 3 years, or if her disability improves greatly.0 -

The case you could be thinking of is Lynn Pilkington, who was being helped by Barry Moss. The reason she was successful was that she had parked on the white line in a bay, but the signs did not drivers had to park "wholly" within a bay.
Since then, Barry Moss has reported the council to the police with regard to wrongly-sized on-street bays. They were being investigated for the possible offence of malfeasance - they were advised the bays were wrong, but continued to issue tickets, knowing that they shouldn't do.
They are currently hurriedly repainting all the bays, although Mr Moss insists they are still not legal!! It really shouldn't be so hard for them - all they have to do is to copy the drawings that the DFT provide them with. And they still canm't get it right!!!
And all this on top of them getting the wording on their FPNs wrong too!!!0 -

If you are parking in a private car park, you can legally park anywhere. You do not have to display a blue badge, and the P&C spaces are nothing more than ordinary spaces duabed with paint. You CANNOT be fined for using them.0 -

It may not be legally wrong to use a space designated for a disabled person in a private car park, but it is most certainly morally wrong!I let my mind wander and it never came back!0 -

Yes, maybe I could have gone to appeal and maybe won but I couldn't be bothered. The parking bay had been temporarily suspended and wasn't clearly marked in my opinion. The notice about which bays were suspended was ambiguous. I genuinely thought I could park there. The fine was only £30 I think so I just paid up. However, had I just ignored them they would have taken my to court.
With private companies if you ignore them they do nothing except send threatening and misleading pseudo legal letters. Ignore them and nothing happens.0 -

The conduct of these private parking companies is so underhand and loathsome that they I feel no moral obligation to them or the companies that employ them.0 -
