Parking ticket in Asda car park - Is this legal, can they take me to court?

which makes you wonder what the point is of having different types of parking bays!
Because the majority will comply.
Either because they don't know it's not enforceable or just because they think it's the right thing to do.0 -

I went to the sunbed shop in which is in ASDA car park, and when I drove off I realised that I had lefted my jewellery there so I drove back and parked in a disabled carpark, ran in the shop and ran back out. When I came back I had a £90 fine for parking there. I cant believe I got one, you dont even get that kind of fine speeding?? Is there anything I can do??0

Yes there is. As others have pointed out, don't park in the disabled bay and be grateful that you can run!0

Absolutely there is.
DO NOT PAY IT!!!
It is not a fine. It is an invoice for an alleged contract between THE DRIVER of the vehicle (not the registered keeper) and AsdA. It has no real basis in law at all.
They may send you a few threatening letters, but at the end of the day, they will NOT take you to Court, as they know they would not win.
For now, ignore it. I am assuming that you are the registered keeper? If so, await a reminder, then write to them, stating that they should pursue the driver for payment of any monies they believe are due, and that you, as the registered keeper are not obliged to pay; nor are you obliged to reveal details of the driver. They will tell you that you MUST tell them, and that you MUST pay as RK, But this is a lie. It is simply untrue.
You can also tell them that the only further correspondence you want from them is to confirm that the matter has been dropped. Any other correspondence will constitute harassment, and you will have to consider taking action against them.
Please, please, please do not pay this ticket.
And in future, don't park in disabled spaces.

Pay the fine!
I'm able bodied and I find it sickening that "people" can't be bothered to walk an extra 10 metres or so to use a cash point or pop into a shop. What is wrong with people in this country? I've seen garages/driveways where homeowners have had to put up signs telling people not to park infront of their driveway/garage. This form of obstruction is actually against the law, yet householders have been forced to put up signs.
Sometimes I feel dealing with adults in this country is like (if not worse than) dealing with little children who think they should be able to do just what they want and don't see anything wrong in what they're doing and won't accept the consequences.
sarahg1969 - I hope for your sake you are never in the position of being disabled or caring for someone who is and not being able to find a parking space!

I am not in any way condoning what klofty has done.
I am simply pointing out the legalities of the invoice issued to him.
He has NOT been fined. He has been invoiced by Asda's agents. He is not obliged to pay the invoice at all.
I can understand that you feel aggrieved by people who use disabled spaces when they shouldn't, and I agree that it's a bad thing to do.
BUT, the fact remains that the so-called fine is not enforceable.
Klofty paying, or not paying, the invoice will have no impact whatsoever on you or anyone else. Except that it encourages these bandits to carry out extorting money from people.0 -

I think these fines and bays should be enforceable. I'm fed up with having to put off my shopping or visit to the doctor because some incondsiderate muppet has parked in the disabled bay. As you may have guessed I am disabled!
Many places I cannot park elsewhere as I need the wider spaces/extra room to get in and out of my vehicle.
All these people who say I'm only going to be 2 minutes or ran back in and out:rolleyes: . Sorry but you know you shouldn't have parked there and you were there long enough for someone to give you a ticket.
Not paying the fine sends the message that it is perfectly ok to park in disabled bays. Doesn't matter what the legality its morally wrong and everyone knows this.
Yeah, sure as law stands everyone and their maiden aunt can park in blue badge bays but if they do then that makes them very inconsiderate and thoughtless.
Anyone I catch in a disabled bay without a badge gets this or one of these put on their car.0 -
