Then report them for non-compliance with the DPA - https://www.informationcommissioner.gov.uk
Let them know that you will be doing so, and let the IC know that they have refused even though they have taken the money.0 -
I have just called them quoting the wording out of the interpretation document from the IC. The person I spoke to this morning is on lunch but have been promised a callback today.
If they still refuse to budge, I will certainly take your advice and report them. Thanks a lot fo your assistance. I am sure we may be talking again as I have yet to hear back fro one of my other banks that I am chasing.. I've just had Abbey take £110 from my account for being £140 overdrawn for 2 days - unknown to me - there was no contact from them to alert me to this problem, if so I could have resolved it same day. Although no neg balance appears on my statement they seem determined to re-define the meaning of "CURRENT" as in their use of Current Balance - their so called Current Balance doesn't give a true picture of your finances becuase they include uncleared funds. I've just fired of a letter of complaint because I got nowhere with my phone calls...they tried to offer me a portion of the amount as a "Goodwill Gesture" - I refused. This procedure of theirs takes 8 Weeks for them to give an answer.
Is there anything I can do to get my money back quicker without incurring any additional charges???
Needless to say I've just opened an account with another bank this morning and I'll be transferring my funds over in due course.0 -
oh yes - there most certainly is a way you can get your money back - use the pro-forma letter at https://www.bankactiongroup.com - this way you will get ALL charges imposed over a six year span.
There is a step by step instruction 'kit' as to how to get your money back - Abbey have ALWAYS given in and given the money back.
You should have taken the 'goodwill' gesture though - still, never mind, you'll get it ALL back in the end.0 -
Hi Dchurch..I'll check that out. I didn't accept the 'goodwill' gesture because I didn't want it to appear that I accept what they did - I told them I would not accept anything less than 100%0

Ok, here goes, I bank with the Clydesdale bank because they were the only ones who would give me a mortgage.
Can I sue them what with them being a Scottish bank (my branch is in Carlisle, We live near Manchester).
Im probably talking something in the region of 1.5K (think i've kept every statment since we joined them in '97).
Will post an exact figure when i work it all out (don't hold your breath, 6 years, at least two charges a month).
Think i'll do the safe think and look for another bank account beforehand.

While i was just browsing the links in this thread, I noticed that a daily intrest rate of 0.022% is mentioned in the bank_charges_claim_in_person.pdf on the https://www.bankchargeshell.co.uk website, whereas a rate of 0.00022% (post #86) is quoted in this thread, which is correct?0
