aliyah, i read your post a few pages back... shocking stuff. its also the perfect story for the media to cover to highlight the utter !!!!tiness of banks so hopefully the BAG can pass your details on to interested journalists, they'll love the human angle in particular of you having an ill child and buying a nightie whilst youre staying with it in hospital. it makes great copy. i hope you get your money back, im sure you will. i hope you claim for additional damages too in your case as it was obviously a very stressful time for you and the bank despite having an obligation to act "sypathetically" under the banking code failed to do so. i suggest once youve clawed back your money you then make a formal complaint to the ombudsman who will charge them hundreds just to investigate.

yes you can and easier because they can't threaten to close your account. As far as your dealings with the debt collection agency I will let someone else reply to that.

I would be interested to read an answer to this as well. Who do you go after for the charges the debt collection agency or the bank that applied them?

I'm pretty sure accounts in dispute can't be chased by collection agencies, so if you are taking this to court, or at least telling them you are going to, they can't hound you for payments until judgement is complete, which will change balance, and severity of the debt. They should re-instate your credit history relating to any charges, but not sure if anyone has managed to get them to do this. Feel free to correct me anyone
