They can close ranks as much as they like - the fact remains that what they are doing is unlawful.
In a court of law, they would lose - if that's what it takes to get our money back, then that's what it takes.
I have campaigned very hard to get the amount of publicity that this issue is getting now - I have sent 'press releases' from the BAG almost weekly to all the major newspapers and TV studios. I have written letters to MP's, to the Treasury Select Commitee, the OFT, the BBC etc... and it seems to be paying off - the extra pressure seems to be making the OFT do something about it finally.
It's my belief that they will issue a statement soon saying that £15 is a fair charge.
Wrong of course, but it's a step in the right direction.0 -

i have put in my claim for hfax, they r offically served today.
I have noticed though that there are quite a few hfax claims going through at the moment, am wondering if this will go against me at all!
I am sure someone is going to make an example of somebody soon adn quite worried!

It was mentioned in an earlier post that this is the belief , that the Banks will try and make an example of someone .It said in that post that BAG was setting up a buddy support system in this eventuality.I think everyone has been warned that if they start a claim then start it with the belief that it will go into court.Even though up to now a bank will not take this into court.Once you file a claim do your homework .If they are acting legally ,especially after all the bad publicity they have had, wouldn't you think they should of done this by now ? they won't because there is to much evidence collected to prove they are acting unlawfully.Wish I could stop editing EVERY post I make :mad:0 -
Don't be worried Carlih1 - they have no real legal basis to fight your claim.
It makes sense, I think, for banks to give the impression that they will defend themselves.
Firstly, they can say that they have done nothing wrong, bla bla bla, when asked by the media - and say they only finally decided to pay you as a gesture of goodwill, or - as in the recent Manchester case of Lloyds TSB - claim that their £multi-billion company, with it's 1000's of staff, 'forgot' to send a letter to court...
They're always doing that, aren't they? I've lost count of the number of times they've forgotten to send me letter for £28 telling me I was £3 overdrawnAt the last count, it was, erm... zero
Secondly, it's still possible that they can scare off potential claimants just by hinting that they will see you in court. Afterall, it's not a process anyone would enter into just for the fun of it. Even when we know we are in the right, the thought of standing before a 'judge' and facing opposition from a trained, highly paid legal team is not the most pleasant of things..
How many times have they defended themselves in court? I believe it's the same number of times they forgot to send me those letters

I guess it is the worry we all have that "they will make an example of me" I filed my claim against Abbey on Friday with an estimate of charges because they will not provide me with this information even though it has been requested under the DPA. When I woke up this morning I had to pinch myself "little old [young?] me starting a claim in a court" what ever next!0 -

they would have written to you. also you could check your credit file, but if you already know you've been defaulted it would have been placed on your file.
you could ask for it to be removed as part of your case!

well i have letters from halifax notifying me of the charges but they dont say anything about defaults or anything about my credit? i dont really wanna have to pay to see my credit file!!:A Boots Tart :A0

It's only 2 quid - and it may well be worth the 2 quid to have the default removed if there is one.
If it's on there - then make it part of your settlement when/if they attempt to settle out of court. If they don't settle then, great, the judge will make sure that the default is removed.0
