Just a quick note (I know I haven't been in this thread for a few days - the BAG site is taking about 100 hours a week on top of my full time job!! - I am getting very little sleep!!)
Litigation fever is starting to hit - I just wanted to make sure that everyone is aware, that the BAG site, at any one moment has about 15 HSBC staff, 2 Lloyds, and a few Barclaycard IP Addresses in there. These are just the ones that I can trap.
I think this means that we've touched a nerve - we've actually become a thorn in their side (soon to be a bloody big javelin ;-) ).
Banks fight dirty - they WILL try to make an example of someone, probably soon.
I hope it's me, but then I am desperate to get one into a court. I will not be scared off by their attempts to get the case heard in a higher court - in fact I will relish it; a higher court means a precident could be set.
I just wanted people to be aware that they will start to fight dirty soon.
...on a side note - although related. People in the BAG forum have started to put together a 'buddy system', so that if one does go to court, there will be someone in there area who is prepared to go with them; someone hopefully with all the knowledge we can arm them with.0 -

I'd be willing to go all the way too , but that will mean HOURS of rereading everything thats on these sites that I'v read and forgotten.Just 1 question if they did get it in a higher court isn't there then a chance of getting all their costs put on you if you lost , don't shout coz I mentioned the unmentionable word .I just mean a reallyyyyyyyyyyyyyyyyyy slim chance it may be lost .

Have filled out particulars of claim on moneyclaim site, and paid my £120.

Yes there is - but having had lots of legal books donated by way of Amazon by some very kind members of the BAG forum - I feel (and am now backed by some serious legal clout) that confident that I won't lose.
Even if I do lose - the only banks that have robbed me that I haven't successfully recovered my costs from only owe tens of pounds - almost guarenteeing that it'll be heard in the small claims track (even if I wanted to move it to a higher court - I believe that both parties have to agree in most cases. I would agree!), where I would be protected from costs.0 -

Who are you fighting? HSBC or Halifax?
PM me where you live - I would be prepared to come with you to court if you are within say 100 miles of me, should the bank allow it to go that far.
Don;t be scared, be angy; it's the main advantage we have over them - they OWE you that money - the banks (and many others - telco's, big supermarkets etc...) like people to forget about their rights.
In my opinion (and that of thousands of others - just look at the BAG site - 6000 users in 8 weeks!) you are doing the right thing. Big corporations should not be allowed to walk all over the consumers legal rights in this way.
I'm proud of you - for every 10 that threaten their bank, only one will actually do something about the injustice that they dish out.
(BTW - I have it on very good authority that Halifax won't fight that much further than acknowleding the claim with the court ;-) )0 -
The lot of you should just disappear. You are the problem, not the bank, you. Think about it do you drive a car and if you do you would never contemplate parking your car in a parking space without reading the T&C on the parking meter. To refuse you move on, to accept you agree. Do you travel on public transport, you only get on the the bus that takes you home.What other failings have you had in life that raided you pocket or failed your expectations. Roll on the next series of Little Britain, you might be in it.0
