Bank Charges - illegal?

    Just wondering what it means when it states,

    "...Penalty clauses in contracts in English (and Scottish) law for breach of contract are not legal if the penalty exceeds the actual cost of the breach of either party."

    Does this mean that if the value of my returned DD or standing order is higher than the charge then i cannot claim??

    Nickpike - What it means is they should charge you about 30p or so for sending you a letter saying your DD wasnt paid (etc) not a whacking £39.

    Hi, I've just started reading this thread. Is there a page which sets out the steps I need to take, or a website I should read. To be honest it's all a bit difficult to understand so any help on where to start would be appreciated.

    The steps on how to do this was in Martins latest email .look over on the left and click on view past tips .the email containing all the information you are looking for is the top one
    Wish I could stop editing EVERY post I make :mad:

    bobsa1 :- If you read as much of this thread as you can then follow Martins article its under Loans and banking on the left then select bank charges, there is an excelent article by a very knowledgeable chap, also in the article it points you to the bankingaction website that is a wonderfull repository for letters and stuff you may need. Best off luck (not that you will need it)

    Paul-C- has PM'd me to say that the IC has said he will need to submit a complaint of his own in order for them to investigate.

    However, I think it's important that they are just aware (whether officially or not) of how many people the Banks are messing about.

    Have been lurking on this post for a while on my Mum's behalf, shes a complete technophobe, have also been lurking on BAG, anyway 2 days ago we took the plunge and sent the DPA request letters to the following:

    Clydesdale Bank T/A Yorkshire Bank - Yorkshre Bank credit card
    GE Capital Bank - Frasercard
    Lloyds TSB - credit card
    Citi Financial - Citi credit card

    Anyway, my Mum sent all the letters recorded delivery on the 8th, I checked yesterday and some had been delivered, checked today and the rest had been. Mum phoned me at lunchtime to tell me she had a card to collect a letter from the Post Office and also a letter from Yorkshire Bank.

    Recorded letter was from Citi enclosing some disclosure forms for completion and requesting £10. Will have a look at them tomorrow with her.

    The Yorkshire Bank had sent her a letter, whilst still claiming their charges were fair, blah blah blah they were unable to refund her charges but enclosed 6 years of statements as requested and waived any charge. Only they hadn't enclosed said statements so Mum got on the phone and they are being dispatched in tonights post.

    The ball is well and truly rolling..........................
