i HAVE JUST ACCEPTED FULL SETTLEMENT from Lloyds including the addition of 8 percent interest! It's only £160 and of course they are claiming to have done absolutlely nothing wrong but I'm so happy to have beat the barstewards! Absolutley massive thanks to DCChurch.

How long did it take you in total before they paid you Dixie ? was it straight forward with them or did they mess you about a bit first ?

I faffed around with various letters and numerous phone calls and got nowhere. I was about to go on holiday for 3 weeks and wanted to get it sorted so made one last attempt by phone to recover the money. They were crap so that day I started the online claim - it cost £30 but you get that back. On my return I had about 4 letters saying various things. The claim was issued on the 12/2 and deemed served on the 18th. They than had until the 4/3 to respond. In a letter dated the 2 March they offered the full settlement. Nice!

    Hi, Cheddar.

Just to say I have just looked on the bankactiongroup site and your questions don't appear there. There are 4 posts by you, all responses to other posters. When did you post?

Oh I can see I have been told off already about posting on another thread. Thought you would have remember typing in big red bold letters and shouting at me. You also say that your forum is too busy for me to do that ALL THE TIME, I have hardly even posted on there before. :(

I'm very sorry and all that, I had helped someone out on that thread and just asked a quick question as to what method they used. I'll go sit in the corner now. :( Was only trying to get help. :(

I know mjanet but he kinda has told me off on the bankactiongroup site cos I asked a q about statments on a thread someone else has started, I gave the OP some advice and wondered about the DPA thing and got a warning from Bookworm about hi-jacking threads and that I can't keep doing it all the time. :(

The reason for that is, that lots and lots of people have been highjacking threads and when each thread is as specific as those are - it becomes very difficult for the limited number of people moderating/admin-ing the site to keep track.

I for one have a million and one things running in and out of my head at the moment - a structured approach really helps.

Don't take offence - the site is run by 3.5 people and there are over 200 new registrations each day - we're just getting a bit stretched and some people a little stressed with it too.

Don't take it personally - everyone is welcome - with the exception of some banks maybe!!

Yes - if you claim in the county courts for an amount greater than 5k then it might not be heard in the "small claims court" and you would be eligible for the second parties legal costs should you lose.

However, if you were to go to court (and I am not advocating that route), you could ask the judge to allow your case to be heard through the small claim track due to the simplicity of the case.

    It might just work.

...or, if it were me - I might consider breaking the claim down to 1 claim for failed DD's, one for failed SO's, one for breach of OD limit, etc...

    Dchurch

That's why I was going to limit it to just 5k, because my understanding was that this is the most one can claim in the smalls.

If I claim for charges over a given time period that ensures I don't exceed 5k, does that mean that I'm guaranteed to be heard in the small claims court?

Sorry for repeating that question. Just I'm getting a little confused now.

Thanks for all your help though. Great thread.

    Al

PS Good idea re breaking it down into DDs, SOs and so on. Anyone ever had any success with that?

    Hi Dchurch

I am prepared to help with admin or sorting through stuff if you are weighed down with it. If that is in any way feasible let me know.

Thanks hun, its just the comment that I keep doing it that I don't understand! But never mind, water off a ducks back and all that. Does anyone knoe the answers to my other q's though? Don't really know where I should post them on BAG as they're general but my case is againt Natwest, do I post in General or Natwest?

My other q's were if its a joint account do we both have to claim? (OH has been on my a/c for about 3 years.

And I have had different types of account but all with the same a/c no, would I claim separately or all in one go?

    Thanks!
