    Is this the case? I'm concerned as I don't know if I would get a new bank account if they are taking all of your currnet status in to account. Still surviving, but not in a great way.

    I wouldn't like to be stuck without a bank account. Should I hold fire and attempt to get another account before going for these charges and abandon it if I can't get another account?

    i think so. that's what i did.

    i think it's worth remembering you could lose your account/ overdraft if you persue this - and you could end up having to defend your claim in front of a judge and your bank's lawyers...

    it's a great idea but best not rush into claiming thousands without a bit of preparation.

    OK - so I need to see about getting a new account. Is it best to do this with somone with whom I've no current dealings? Mortgage is Lloyds TSB, cards with RBS and BoS who current account is with. Have separate account with BoS, but at same branch as main account.

    In Scotland here, so banking options may be different to those available in England. Any suggestions welcome, or has anyone had experience of taking on BoS and keeping account with them?

  • If your mortgage is with LTSB and you've kept up your payments ok, why not try them. You could explain that as you have a mortgage with them you would like your current account there too to keep things together. I've found them ok.

    one question that has not yet been answered, to my knowledge...

    if a bank was to close an account/ credit card account would they be within their rights to ask for full and immediate repayment?

    and if not, would you be defaulting?

    i think this needs to be known.

    If your mortgage is with LTSB and you've kept up your payments ok, why not try them. You could explain that as you have a mortgage with them you would like your current account there too to keep things together. I've found them ok.

    Mortgage was moved from BoS last year to get better deal. We will possibly be looking to move it again in about 18 months as the two year deal will be up. No problem with mortgage payments - both with BoS and Lloyds.

    Is the transfer fairly straightforward and can you usually arrange an immediate overdraft facility as I'd need to transfer the BoS overdraft until the charges are sorted out.

    Sorry I've just posted in another forum then found this.

    I'm helping my friend with her debt problems. It seems her bank have charged her £254 in the last 8 days alone. This is for direct debits bouncing or through "card misuse" for writing cheques which took her over the overdraft.

    Looking through her statements, she was charged £513 in charges in the period 13Jan to 13Feb.

    So its likely she has been paying 6k of charges over the year.

    How far back can one go in claiming these charges back?

    Any help gratefully received

    Under the statute of limitations you are entitled to go back six years.

    May be worth you having a look at https://www.bankactiongroup.com website for template letters in the library section.

    I would just ignore the letter they have sent you, and write giving them 7 days notice of legal action saying if this amount is not paid you will immediately commence legal proceedings without further reference. Inform them that court fees, costs and interest (at 8% APR) will be added. Head your letter 'Final Notice Before Legal Action'.

    Clearly at the moment they do not think you are serious, or that you can be fobbed off. If they do not respond with full payment then you will have to commence court action. Visit https://www.moneyclaim.gov.uk to commence legal action.

    This is exactly how your bank would treat you, and you need to develop a mindset of brute arrogance and treat them with the same disdain and contempt that they would afford you.
