    Far more easily said than done. Have got a lot of stress on my plate at the moment and this is the last thing that I need. Will send the replacement recorded delivery letter as soon as possible and hopefully that will be the end of it.

    All they can do is send letters, nothing to be scared of.

    If the debt is 11+ years old, then there's sod all they can do. You can calm down safe in the knowledge you have the law on YOUR side.

    Hey guys,

    My dad is having the same problem. He got a call from a Company called Fenton Cooper asking him about a £2800 debt from Halifax back in 1996. Do you think they can do anything about it, I know after 6 years the debt gets written off but my dad is worried about this. He lives on income support and is disabled and unable to work.

    A debt becomes statute barred as long there is no payment or acknowledgement of it for a total of 6 years (5 in Scotland). They will send letters and possibly call if they get a contact number to try to pursue the debt in the hope that someone will be afraid and pay, but they will take no further action (they usually threaten court etc). Tell your Dad not to worry.
    If you've nothing decent to say, perhaps you shouldn't say anything.

    Provided he hasn't acknowledged the debt in writing or made a payment in the last 6 years, there is diddly squat they can do.

    What they are doing here, and it's what most other DCA's do with statute barred debts is call you or send threatening letters in the hope who they are speaking to doesn't know their rights.

    Unenforceable, rather than written-off (England/Wales)

    They are becoming more desperate, ringing in the morning but we have their number so we know who it is. We don't answer. Anything we can do or just let them keep ringing and hope they stop?
