Old Debt? Mackenzie Hall
Comments
-
I've just checked my Credit Report and it has a default on it put there by this Mackenzie Hall. I'd never heard of them until looking it up on this forum. It says it's for 'Mail Order' to the tune of around £750! I've never had anything mail order and I don't think I owe this debt. Are they allowed to put a default on my Credit Record without any attempt to contact me? Do I need to write to them asking for proof? I'm aware that this would be opening up the floodgates to grief if I do after reading these posts lol. Could really do with getting it off my credit file if at all possible. Any advice would be appreciated.
If that default's been put there by them and they can't prove any evidence of debt (and I can tell you now they won't!), you can write to them and get them to remove that default, and write to the reference agency who's listed the default.
If they still refuse, then that default entry can be interpreted as defamation - and you can take appropriate legal steps to possibly sue either MH or the reference agency if they do not remove that default entry.
Have a look around google to see if you can find any similar problems to your own - I can guarantee you will find a few.
Lowell and Aktiv Kapital have been known to log wrong default entries, and have lost out big time for doing it.
A couple of golden rules to observe :-
1) Any written contact should be sent via recorded delivery, and NEVER include your signature in any correspondence you send to a DCA.
2) Never phone a DCA - all contact must be in writing only.0 -
That's great. I appreciate your advice and will post an unsigned/recorded letter initially. Thanks again.0

Fishing letter at best.
Personally, I would ignore it until they can be bothered to write saying what it is actually about.
If it is yours, then it will almost certainly be statute barred.

Ive received my 3rd text from these guys today, should i just continue to ignore it? it doesnt state my name or what its about, just a ref number.
Im concerned because none of my debts would be statute bared yet as far as i know, although they have all been satisfied/settled over 2 years ago.
its the 'satisfied' ones im concerned about as technically the creditor did not receive the full and final balance, but rather an amount to close the account, and they are registered as satisfied on my credit reports.
should i be worried?0 -
I would continue to ignore until they actually write to tell you what debt it is about or how much they think you owe etc.
Regarding your reduced settled debts - do you have something in writing to say that your payments were full & final settlements? If so make sure you hang on to them in case MacHall do turn out to be trying to chase these.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

i dont think i doi did a lot of dealings on the phone back then, and anything i did have may have been destroyed by now as i didnt think id need it over 2 years later.
The only thing I have is my credit reports which say 'Satisfied' on some of them. I think some of them even say that a reduced payment was taken to settle the account0 -
so a letter has come today, we are trying to locate blah de blah. The weird thing is that muck hall closed the 4 accounts I allegedly owed them in sept 2009, then I had 6 searches on my credit file last june which were removed after getting in touch with them as I explained they knew where I was through me talking to them in 2009, There is no debts on either credit file I have totally up to date files as I subscribe to both equifax and experian. Should I ring these cowboys to find out what this debt is as no details in the letter or on my credit files, or wait and see what happens, I have no debts since 2003 when they were all paid off. Also my first name is not quite right it is joanne not joanna as on the envelope.0

My wife got one today; please contact us over a personal matter etc. It is in her maiden name since she has been married over 6 years any debts will be statute barred. Not that we can think of any outstanding debt and the credit report is clear.
I'll worry about it if they send a Court Summons, until then all correspondance goes in the bin.0 -

As said in previous posts, until they can be bothered with writing with proper details of the debt, they aren't worth wasting breath or ink and paper on.bigbadandy wrote: »My wife got one today; please contact us over a personal matter etc. It is in her maiden name since she has been married over 6 years any debts will be statute barred.
