Just a quick point about losing the recorded delivery receipt - assuming that you have entered the tracking number on RM web site, you may find that if you go into the tracking page, you might be able to find the reference through autofill. Good luck:)0

Buyer has purchased item from me and I have sent it, they have received item,...item was wrong size for buyer, so i offered buyer a full refund, buyer is stating they have sent the item back to me on the 22/08/08 via 1st class post. However I have not received the item. Buyer is stating he has proof of P&P but sent item 1st class and not recorded value of item is £6o odd. I have responded with the buyer promptly via ebay, buyer has also asked for half the money to be refunded, but I refused as i do not have the item.
Now buyer has opened an item not received dispute against me. I have proof of P&P as thankfully I sent item recorded del. & I have emails from buyer stating item has been received. Paypal are holding the funds from my acc.
Where do I stand? I also have the option to escalate dispute to a claim. What will happen? I mean I dont want to be £60.00 out of pocket for something which I have sent and do not have anymore. Also read on these forums paypal and ebay can be a bit of an assache for sellers???? is this right??
TIA for you replies ......

If you still have all the communication between you where the buyer says it's the wrong size then you'll win as it obviously arrived.

Hi guys,
Its been a week now
I haven't heard anything from the buyer, not even a reply to my message, paypal are still holding my funds and the dispute is still opened??? BTW forgot to mention previously buyer also said they would leave me a neg..can they do that?
What shall I do? & how long can paypal hold the funds for? The dispute can be escalated into a claim until the 27/09/08.

Paypal will hold the funds until all avenues have been done and dusted, that will include allowing for the buyer to esxcalate toa claim, they may be holding on to the last possible moment b4 filing it up to a cliam in the hopes that you will go ah ok, heres the money. Plz plz dont, then the buyer will go to a dispute, again they will give their reasoning, then you reply, but check what she is actually claiming for, is it item not recieved, which if it is you have the emails sent via ebay messageing that she says she has recieved it. You can ask ebay to allow you to post the copies to them, as they ask for the email heading line, (if you have the emails stored in inbox that should be easy to retrieve), if not go for the postage route.
Disputes can take upto 60 days to go though, it depends on how quick all the parties put in their comments.
To be honest once you start producing documentation that she says she recieved it, it boils down to she never sent it back recorded delievery, or she wants to keep the item but not pay for it.
I know it feels like its going to drag on, but remember you are in the right, you did it by the book, (ie recorded delievery) and YOU ARE IN THE RIGHT.

Yes your buyer is quite free to leave you negative feedback. On a plus for you, if the buyer proceeds with this course of action and actually wins the paypal dispute, it is a clear case of theft. You buyer will have dishonestly appropriated property, ie the refund amount and therefore should be reported to the police.0 -
If you have found the tracking number then just escalate it and give the number to paypal.
Should be over a lot quicker then.0 -

For a quiet life I would refund £24 and let her claim the other £36 from RM.0

Got to agree with that. Is this hassle really worth the £24? Pay up the £24, call them a ratbag (to yourself) and get it out of your system and get on with the important things in life. Beware of thier user name with any other auctions you have on the go now or in the future.
