Need some advice please....

Hi all,

Buyer has purchased item from me and I have sent it, they have received item,...item was wrong size for buyer, so i offered buyer a full refund, buyer is stating they have sent the item back to me on the 22/08/08 via 1st class post. However I have not received the item. Buyer is stating he has proof of P&P but sent item 1st class and not recorded value of item is £6o odd. I have responded with the buyer promptly via ebay, buyer has also asked for half the money to be refunded, but I refused as i do not have the item.

Now buyer has opened an item not received dispute against me. I have proof of P&P as thankfully I sent item recorded del. & I have emails from buyer stating item has been received. Paypal are holding the funds from my acc.

Where do I stand? I also have the option to escalate dispute to a claim. What will happen? I mean I dont want to be £60.00 out of pocket for something which I have sent and do not have anymore. Also read on these forums paypal and ebay can be a bit of an assache for sellers???? is this right??

    Difficult this one. Unless buyer gets her £60 my guess is she'll want to leave negative and there is s*d all you can do about it. The feedback that you used to be able to leave as a seller, which offered some deterrent, was taken away a few months ago by our friends at ebay.

    As for the money. As soon as you show that you sent it by recorded the onus would be on the buyer doing the same. My guess is the reason she wants £30 ish is because she can claim the other £30 from Royal Mail. Explain to her that you are sorry the item was lost in the post. You will help her with any paperwork (which is minimal) to recover the £30 ish off Royal Mail and you expect your money to be paid by Paypal, which I'm sure it will.

    Just escalate it with paypal and give them the tracking number.

    They will lose as you have not received it back and as they didn't send it recorded they have no tracking details to prove otherwise.

    thanks for that, but buyer asked me for half the refund through ebay, didnt mention claimin half from RM. The exact words were "Refund me half the money & then we will both be at the same loss"...Its only about 1 week later that buyer has opened dispute with paypal. (today)...& what do you mean by " you expect your money to be paid by Paypal, which I'm sure it will."

    What they mean is give me half back. You will feel we both are at the same loss but really I'll go to Royal Mail and claim back the other half.

    Nothing sinister in the other comment, just that I expect Paypal to hold up in your favour.

    SH*T, I cant find my recipt:mad::mad::mad::mad: but Im sure its lying around somewhere....fingers crossed...I also have emails and ebay messages etc and also in the paypal dispute buyer has wrote that they have received item...will this also go in my favour.....because fingers crossed I should..but at the moment cant find the bloody RM receipt..:eek::eek::eek::eek:

    Just a quick recap, did the seller pay £60 for the item, if you have proof of recorded delievery and emails that prroves she/he had the item, then you need to supply proof of all this to paypal or ebay. (i had to send documents to Dublin).
    again if the seller returned with only proof of purchase (same as recorded deleivery), is only covered upto £30. So basically they claim £30 off you, £30 from Royal Mail there quits in.
    PersonallY I would refuse to pay anything and put the claim upto a dispute.

    This is what Royal Mail say:

    How much compensation will I get if my item is lost or damaged? If your item is lost or damaged in transit, we will pay compensation of up to £36 per item upon production of a copy of the certificate of posting and proof of item value. You can send items with International Signed For™ from a Post Office™.

    So if your buyer sent it back and got a CoP then they can claim up to £36 from Royal Mail. I would make sure you keep everything you need so you can keep it for Ebay and keep your originals only let them have copies.

    Buyer opened dispute stating "You have sent the item fine, it was wrong, you offered a refund I returned, you havent received."

    so Ive sent a message back stating "yes xxxx this is the same thing we have been discussing via ebay in our messages"

    Now do I wait for them to reply or shall I just escalate to a claim???

    I dont know im just confused and 37+ wks preg..I cant keep up with it all.

    From what I can see you aren't the one claiming. I would update the reply saying 'that as you confirm you received the item. I am happy to help in whatever way I can. Can you please clarify how you returned the item - was it recorded?'

    This should catch them out and help you with paypal.
