Please send in the AoS to the court re the CCJ. Once the extra 14 days are up you can string it along for quite some time to give you space for BR. When are you going BR?
One of the Cc companies are applying for a CCJ so things are hotting up.
Now for the questions - be sure you send back the Acknowledgement of Service and say you will be disputing the whole amount - this buys you 14 more days. You don't want a CCJ even though it would be wiped out in BR its a pain to have to deal with.
1. If I were to go BR before we rent somewhere what would the downside be? Given that my credit rating is already shot and we'll have to do the 6 months rent/gaurantor thing anyway. not sure there is a downside
2. If I spoke to the mortgage companies and told them I wanted to vol repo when would they expect us to move out - straight away or is there a delay while they send paperwork etc (which I won't sign anyway).
3. If cc company do get their CCJ will this be included in BR? yes but see above. When are you planning on BR?
Think thats all for now but there will be more to come as I need to move this forward now.
Thanks.

I went to a walk in service however they certainly saw more than 6 people in my court. What time did they advise to get there? Just be sure to get there early and have everything ready. I went to RCJ in London and I was the first one there an hour before opening time.Hi all,
Just in addition to the questions above (which I'd really welcome peoples thoughts on) has anyone any experience of going BR at courts where they operate a 'walk in' service? This is the case at the court I'll be using for BR (Derby) and I've booked a couple of days off work in a couple of weeks time when I might well bite the bullet but the court say they only see 6 people each day. Just wonder whether anyone can give any clues as to how likely I would be to be seen etc (obviously I would arrive early). I can't imagine anything worse than getting all geared up and then not being seen on that day, plus I can't keep having time off work to turn up at court.
As always any thoughts or advice would much appreciated.
Thanks.

Thanks for the advice, I had a bit of a head in the sand period over Christmas I'm afraid so think I may just be out of time for returning the aos but I will post it tomorrow anyway - just in case they are a little more leniant in view of xmas post and bank hols etc.
Was trying to delay going BR until we'd found a rental property and moved but thats taken longer than we'd hoped so the pressure is now starting to mount. Therefore I thought that I might go BR before we move, so probably the week after next when I've booked a couple of days off work. (Blimey its quite scarey when I think of it being that close).
I am hoping that we'll at least have a rental sorted out by then even if we haven't quite moved in so I could put rent etc on soa.
The court didn't give any idea of an arrival time but were very clear that they see a maximum of 6 people per day. My plan was to arrive early-I can't stand the thought of all that stress before hand only to be the 7th person to arrive and have to go back another day.

Thanks very much. Don't know about the alarm, can't see me getting much sleep the night before and knowing my compulsion to be on time for things I'll be the one waiting outside the court at the crack of dawn, sat on a deckchair with a thermos in my hand (and 3xcopies of all paperwork in the other).
Thanks again.
PS - discovered you can submit aos online so thats now done.
Just all the BR forms to go!0 -
Good that you've submitted the AoS - was it in time?

Well it didn't give any response either way tbh so not sure but going by the date on which it would have been deemed it was served (24th Dec 08) then probably not. Can only hope they might give a few days leeway what with Christmas and New year. I might just get the BR in before the 28days is up if they do give me the extra time!
Thats what happens when you try to ignore these things over Christmas and then forget about them so it serves me right really.
Thanks again for your help.0 -
Just read through your thread and whilst I cant offer any advice, as am still in that decision period myself, I just wanted to say good luck and I hope everything works out for you. Keeping positive is the main thing and you are sounding that! Well done for taking responsibility and doing your best!0

Thanks for those kind words blue. If you'd ssen me yesterday afternoon trying to fill in my soa you wouldn't have thought me quite so positive but I guess everyone has moments where the enormity of it all hits them and that was one of mine (I'm sure there'll be more to come!)
I see you have an appointment with CCCS soon I hope that goes well for you and you get some good advice from it and well done to you too for trying to sort your situation.

Well the lovely house that we viewed last weekend is not going o be our new home!
The letting agent called me yesterday, very apologetis but the landlord has decided to rent it out to a friend of his - I'm fuming, it's been up for rent for quite a while so just seems such bad luck that just as we put our application in a friend of his also wants it.
I am starting to panic a bit now to be honest as there are very few properties available for rent in our area at the moment - still we'll just have to keep looking.
It does put me in a quandry though as I was hoping to get BR done and dusted next week but don't see how I can fill my soa in when I'm not paying my mortgage and don't know how much rent etc will be in a new house - anyone got any ideas please?
Thanks0
