    Thank you all, will need to check that out then as I live in a bit of a strange area where the borders of 3 counties meet and am not sure if same court will cover current and potential new address.

    Just a quick update, the house we had viewed didn't work out unfortunately. Despite jumping through the various hurdles regarding gaurantors etc it turned out that the insurance policy that the landlord was insisting on using would only cover them for a tenant with a perfect credit check (which ours was far from being). So that was a 105.00 pounds wasted on credit checks for us and our gaurantor. Our options for places to rent are very limited at the moment so I am starting to get quite worried about finding somewhere. The calls have died down a little at the moment which is probably the lull before the storm!
    Contacted my local court and its a drop in service for BR although they only see 6 people per day, so that could be a little awkward as with working I can't keep having mornings off to turn up there, I guess I just need to arrive very early so I'm one of the first. Am now considering going BR before we actually move because of the issue with moving into a different courts area and having to wait 6 months but could I still explain that potential repo and shortfall have contributed to my decision to go BR?

    I have just read through your thread and want to wish you luck.

    I am in the same situation, looking to rent. I have a bad credit file now as I am on a DMP and arrears on the mortgage. I have put in an offer on a place to rent and am waiting to hear. I have not said anything to the estate agents about my credit rateing at all. But reading your thread I think thats probably a good idea as cant afford to loose the 105 admin fee. I dont think though that I will say that I am going BR though....I dont know?

    Hope everything works out for you with the house that you've applied for.
    I decided, following advise on here, that honesty was the best policy and I told the letting agent everything about my situation including the fact that I may go BR. They checked all of this with the LL of the house we were interested in who said initially that they would accept us with a gaurantor hence the reason we handed over fees for credit checks etc but having gone through all of that we then found out that the landlords insurance wouldn't cover them if they took us as tenants because we didn't have a good credit rating.
    I suppose one problem is that if you're not upfront at the begining then you stand more chance of losing fees that you've paid when they realise that your credit report isn't good, whereas if you tell them everyhting upfront then the LL can make a decision before you hand over any fees.

    Good luck Silou. What if you use the same agent, will you have to pay for another credit check? Also it may be an idea to ask about LL's insurance before you have any other credit checks.

    Regarding the court, if you move house and it is in another court area then you would go to the court where your previous house was as you were there for most of the last 6 months - you don't have to wait. At least thats the way I've always understood it maybe someone will correct/confirm!

    Ah, thats good news regarding the court situation. I couldn't quite understand how it all worked so thats really helpful to know.
    Regarding the credit check money, we had left our application fee with the agent as they thought they may have another suitable property coming onto their books - it did but they wouldn't allow pets so no good to us. I am going to call them today to see if they have anything else coming up but if not I will be trying to get all the money bak from them because had they told us about the LL's insurance at the outset I would never have handed any money over as I knew we wouldn't have a good credit rating and so did the agent as I told them all about my situation before we even viewed the house. I almost feel like I handed over that money under false pretences as we never stood a chance of being accepted as tenants.
    I have learnt something from it though and will definitely be asking for the insurance situation to be checked before I hand any more money over to anyone.

    I have been reading your thread and have become hooked. Like me, you started off knowing that you were going to hit problems in the future and did something about it before it got really bad. I have picked up a lot of tips and info and it has given me a lot of reassurance. Although I live alone,I never feel I am on my own with this forum and the great posters.

    Hi startagain - sorry I missed your post and thanks for your good wishes, thats the lovely thing about posting on here you never feel alone!

    Its a been a while since the last update because nothing much has happened until now.
    I think the letting agent has spent the last couple of months leading us on, there was always about to be something sutable coming onto their books which always turned out not to suited to us (no pets etc) and when something did turn up last week I found it on rightmove as they hadn't bothered to tell us about it and they've spent since then allegedly trying to contact the LL!
    We are viewing a house with a different agent tomorrow so fingers crossed.

    Mortgage co. 1 have written today saying that if I don't pay up within 15 days they will start repo proceedings.
    SL co. sent someone round to the house yesterday, DD answered door (and won't be doing that again!) told woman I wasn't home and she just left a card and has tried to call me today.
    One of the Cc companies are applying for a CCJ so things are hotting up.
    Now for the questions -
    1. If I were to go BR before we rent somewhere what would the downside be? Given that my credit rating is already shot and we'll have to do the 6 months rent/gaurantor thing anyway.
    2. If I spoke to the mortgage companies and told them I wanted to vol repo when would they expect us to move out - straight away or is there a delay while they send paperwork etc (which I won't sign anyway).
    3. If cc company do get their CCJ will this be included in BR?

    Think thats all for now but there will be more to come as I need to move this forward now.

    Hi all,
    Just in addition to the questions above (which I'd really welcome peoples thoughts on) has anyone any experience of going BR at courts where they operate a 'walk in' service? This is the case at the court I'll be using for BR (Derby) and I've booked a couple of days off work in a couple of weeks time when I might well bite the bullet but the court say they only see 6 people each day. Just wonder whether anyone can give any clues as to how likely I would be to be seen etc (obviously I would arrive early). I can't imagine anything worse than getting all geared up and then not being seen on that day, plus I can't keep having time off work to turn up at court.
    As always any thoughts or advice would much appreciated.

    If anyone can give any thoughts on the questions in the above 2 posts I'd be really grateful.

    We viewed the house yesterday and it's lovely so we've put in an application. This letting agent seemed far more relaxed about my situation than the one that we dealt with previously so for anyone in a similar situation, if the first agent you go to isn't sympathetic try others! Basically as long as we have 6 months rent in advance there should be no problem, so fingers crosssed. They've sent me a copy of their AST and I can't see any reference to bankruptcy so would there ne any reason for the OR to contact the landlord?

    I realise I've raised a lot of questions over the last few posts and it's very busy on here at the moment but if anyone has any thoughts of any of this I'd love to hear them.
