Sandypepper wrote: »2nd call from them today a woman this time telling me 'we need to resolve the problem' I told her I was only going to deal by mail and she stated they are a telephone based company and would not respond to any letters should be interesting! Will keep you posted.
What a bunch of clowns we all seem to be dealing with. If they are "telephone based" then why do THEY SEND US nasty letters in the post???????????????:rotfl: :rotfl:0 -
Stating that they are telephone -based is about as much use as me telling them that I have the money!!
If you write ( e-mail is good as they have an automated response which immediately validates delivery ) and request that ALL communication should be in writing then they HAVE to comply otherwise they are breaking OFT Guidelines again. and again. and again.
I also found that ( before I realised my rights ) asking why the caller didnt get a worthwhile job working the phone for a charity was, apparently, none of my business......I was only interested in her spiritual wellbeing!!:rotfl::D stay wonky

Update on my 1st Credit experience - sent off CCA request on 1st Sept, recorded delivery. Received the notice of assignment quickly, but no CCA (apparently they don't hold it but OC Lombard do) - anyway about to send my 12+2 letter today and yesterday, I received another copy of the notice of assignment with a paragraph telling me its my 'last chance to do something about it'.........._pale_......I'm worried, as you can tell;)WARNING!Alcohol can make you think you are more interesting and attractive than you actually are.....0

Moneymare,
Hang in there, they know that they have screwed up by not having the CCA, they also dont know for certain that the original creditors DOES have the CCA! So now they are trying to scare you into stopping you going any further down that route, like I said in prev post, asking for these parasites to confirm their position is like poking a wasp nest with a stick!!.
If you are making payments to them and thy are banking the money ( especially if its via a dmp ) then you have the advantage at the moment, even if they are saying tht they have not accepted any arrangements.
Stick to your guns, if no CCA then great. If ther is CCA then they'll prob shut up after a while anyway because of the payments.:D stay wonky

New here. I got a phone call from 1st credit on saturday, very threatening, to take me to court, send bailiffs round, put a charge on my house etc. I had that morning received a notice of assignment from goldfish (although the address on the envelope was the same as 1st credits, from whom I received a letter this morning, saying I now owed the money to them). I had made a private agreement with goldfish to pay a monthly amount according to what I could afford. 1st credit are demanding a lump sum 'up front', plus over 4 times the monthly amount I had agreed with goldfish, which is obviously more than I can afford. I don't have a dmp with anyone, as I arranged this with my individual credits. I reitred onb the grounds of ill health, as I suffer from depression, and am dreading the thought of another phone call tomorrow. Should I now ask for a CCA even though I have already received notice of assignment and statement? should I ask for an SAR, and refuse to speak to the nasty little man who phoned before? Advice welcomed. Jul 2008 debt £36,600 (not including mortgage )0

Hi
Start by requesting the CCA.
And refuse to answer the security questions. I have to go but will look in tomorow and post a letter you can use to insist they communicate in writing. If you've have not made a mistake, you've made nothing0 -
Hello Debtlady,
have a look on www.oft.gov.uk and see what your rights are regarding debt collectors. Particularly regarding communication and your healyh and wellbeing.
This bunch ( 1st Cretins ) break all the rules and believe they can do so with impunity. They dont like it when they get resistance from people armed with the correct info.
Have a good read on this thread. Continue to make your reg payment to them as you were to goldfish.
Only contact them by reg post, e-mail is good also.
Good luck,
Pepe:D stay wonky
