    Sent CCA request on Monday 15th September via email. Heard nothing from 1st credit, so phoned them up. Actually spoke to someone who was polite for a change. He said that they had past the request on to Goldfish and that they would contact me about it. Still heard nothing from Goldfish!?!?!?!?!?!? Not sent a fee payment, but they haven't asked for one. Do you have to always pay for it or does it depend on whether or not the creditor asks for payment?:confused: Does the 12+2 rule still apply?:confused:

    It arrived in the post today. Well, an edited version of it. They have asked for signature verification before releasing the unedited version. Is this normal pratice?
  • i wouldnt sign ANYTHING that they are going to get their mucky hands on. Some DCA forge signatures (or so im told)

    No. There is no need to provide that.

    Response to a request for a specimen signature before a creditor/DCA will comply with a CCA request.
    Dear Sir/Madam,

    RE: Account NO XXXXXXXX

    Thank you for your letter dated xx/xx/2008 the contents of which are noted.

    In your letter you make reference to requiring my signed authorisation /specimen signature** before you comply. I draw your attention to the fact that the Consumer Credit Act 1974 does not require that i supply you a copy of my signature before you comply with my S77/78** request.

    If it is for Data Protection purposes then i can happily supply you with documentation to substantiate my identity to you.

    However please note that to date you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this?

    As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:

    7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.

    My request for a true copy of my credit agreement under section 77/78** was made on xx/xx/2008 and the 12 working days for your compliance expire on xx/xx/2008.

    I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity.

    I look forward to receiving the documentation requested

  • Had already replied to this question on another thread, before seeing this letter from fermi. Just about summarises the whole point. If the DCA has been writing to someone, they have presumably been relaying financial information without any certainty that they have the correct person, but need to check identity before sending something you have requested and are legally entitiled to?

    Are they having a laugh?

    I received what appears to be a bog standard letter from 1st credit in response to my request for a CCA - they don't have it, but will ask Goldfish to pass it on. At least the phone calls have stopped. Watch this space...

    They dont actually ask me to send a sample signature, just to contact them to say that the signature on the agreement they sent me is mine. They then go on a rant about fraud prevention etc.

    Hi,

    You know how a credit agreement application form is made of different sectons - personal, employment, financial details etc. Part of section 4 (finances) and the whole of section 5 are blanked out. I think section 5 is the part about optional ppi protection, as this not mentioned anywhere. This is what I am interested in as ppi was mis-sold on this credit card. I dont think that this is a co-incidence. I'm sure they know this and are trying to avoid me claiming a refund.
