it is extremely important that you get that CCA letter out this week. Remember to send it registered post so you can trace when they sign for it and print your name rather than sign. Once you send that, the debt is in dispute.
If 1st credit do not have the CCA, they cannot even get a CCJ against you or enforce one if they have one. You then have a choice of whether to pay them anything or not.
You need them to get it before September 17.
In the mean-time please contact CCCS and ask them to revert to the old payment plan
CCA request along with a letter to stop calls was sent earlier.

If the CCA is not returned to you after 12 days, 1st credit cannot take you to court until they produce it, as they are in default.
You would be quite within your rights not to pay any more. Alternatively, since you now have them over a barrel, you can continue paying your old amount and they can do nothing about the situation.If you've have not made a mistake, you've made nothing0 -
Just checked the royal mail website and the two letters were received and signed for yesterday.
Will asking for a CCA tick them off??
Ironically i will probably receive a barrage of phonecalls now despite my letter. To be honest i dont care how often they ring my mobile cos i just wont pick it up i just dont want them phoning the house phone all the time, just makes it a bit awkward for me.0 -
1st credit have been phoning me everyday since they received my CCA request.......unfortunately for them, they only have my mobile number so I can see it is them and ignore it...the 12+2 deadline is up on the 15th of this month.

What i dont understand is why wouldn't they have a a CCA.
As far as i know the process is that a DCA will buy a debt for a creditor. surely they would make sure they have all the correct paperwrok to be able enforce the debt.0 -
Thanks again RAS, that it very interesting. Maybe I should send requests to all of my creditors before they get to DCA stage??
Also the guy from 1st Credit made it sound as though they had cherry picked my account from Citi specifically because I have a lot to loose (ie. My house) if I do not pay back their £1700 in full.

1st Crudit recently sent me the threatening letter 'we've checked Land Registry etc' but they have shut up since my Complaint to their Compliance Officer ( Audrey Shim Quee ). My DMP is in place with CCCS, 10 months now, and I've insisted in all comm in writing.
Also I send them e-mails asking them to confirm the content of their threatening calls ( pre written-only instructions )on a regular basis so that ther is a continuous record of their attempted actions/abuse.
Is quiet good? Who knows.....bring it on 1st Cr...then I send the CCA.
Citi still comm with me as if they still have the debt so I think I may CCA them first?
Spoke to a Unite Union rep today, they seem to be interested in the actions of this sort of Co:D stay wonky

Hi all,
Just found this thread and have scanned the posts so far.
I too have had the pleasure of dealing with this company. I am in a DMP with a private company and 1st credit bought the debt from my Goldfish (formally Morgan Stanley) credit card. I owe over £7000 to them.
To cut a long story short, they refused to accept any offer of repayment from my DMP company and threatened us using all of the underhand tactics in previous posts. We were offering them £33.00 a month through the DMP, the same as I started paying Goldfish nearly a year ago. Then last month they told us that unless we increased our payment to £99.00 a month, they would be starting court proceedings against us and obtaining a CCJ. We told them that we couldn't afford it so they said that they would start the ball rolling with their solicitors. They went on to say that as I was a house owner, they would also be applying for a charging order against our house and that they would be requesting that we sell our house immediaely to pay the debt back. I explained that there was no equity in the property, but they said that it didn't matter and that I would lose in court. All this was done through our DMP company who agreed that they COULD do that, but agreed that it would be fairly unlikely to succeed. We never wanted to take the chance so have now started paying the extra by cutting our food budget and living on less food.
After reading other posts about 1st credit, I am now ready for a fight and am going to challenge this. I do not dispute that I owe this debt and do want to repay it, but at what I can afford each month.
I have a couple of questions:
Do they legally own the debt or are they acting for Goldfish?
Who will have the CCA, 1st Credit or Goldfish?
If they dont have it, can they enforce this debt in court?
When I first took out the card (when it was Morgan Stanley), I simply filled in an appliacation form I found in a magazine, waited a couple of weeks and then got the card, without signing anything else. Does this work in my favour?
I want to beat these bullies and play them at their own game. any advice would be geartly appreciated.
