    Thank you for your letter of the 10th Oct. A copy of our complaints precedure has been sent under separate cover.

    We wish to apologise unreservdly for the manner in which the matter has been conduxted.

    We are fully aware that we cannot enforce a debt until teh CCA request has been adhered to,

    As soon as we have recieved the copy agreement from our client it shall be forwarded to you and in teh meantime we have placed a hold on the account.

    it goes on mention about complaining to the financial Ombudsman.

    Where do i go from here. CCCS are still making payments for me to this account. If i ask for the payments are on hold and the come up with the CCA do i just reinstate payments? will they then get a lump sum in one go?
  • Another two letters recieved today. Looks like a computer generated letter to say they have checked the land registry and MAY go for a charging order SHOULD this happen i can be forced to sell.

    i think i need to send another letter to teh compliance officer.
    Are there any complaint templates around where there have not produced a CCA bit still pursue you (even though they told me its on hold)?

    Not a cat in hell's chance of them getting a charging order or anything else until they produce that CCA.

    I would be inclined to report them to the OFT for making threats that they know are unsupportable in law,

    a) given that they have acknowledged that they cannt enforce the debt.
    b) that in law they are not able to enforce a sale even with a charging order in place unless there are serious delinquencies on your part.

    The only delinquents here are 1st Crudit

    Aso send copies of the complaint to Trading Standards nearest their office and write to their Compliane Officer demanding an apology and cessation for haressment.

    Hi Debtman,

    It seems like we are in a similar position regarding this bunch. The 12+2+30 days are up next Monday and they still haven't sent a true copy of the CCA, only that edited version of the application form.
    I too received a letter saying that I had failed to keep to the repayment plan and therefore was in default. It rambles on about starting legal proceedings..........

    I like the sound of that letter you have just received from their complaints department. Where did you send your complaints letter to? I've just been using email as its cheaper the recorded mail and you get an instant confirmation message that they have received it.

    Has anyone actually took on this scum in a court and won? Been searching the forums but cant find anything.

    Very much. There is a classic case on the CAG web-site where a chap was contacted by the OR because 1st Crudit had made him bankrupt without serving the papers properly. First he knew about it. He had two court cases, to overturn the bankruptcy and then to hear the bankruptcy case and won both. The judge was scathing.

    It was overturned because they could not show that they had complied with the proper procedures but even then, the fact that they did not have the CCA meant that if they had the procedures correct, they could not have won the case.

    All my correspondance has been sent recorded mail. I just sent my complaint
    to the usual address and it seems to of filtered through to the compliance officer, which is where the next letters are heading.

    did you send a 12+2+30 letter? i am unsure what to send as i believe the legislation has changed. not sure what i need to send.
